Comment of the Day: Rev. Jonathan Ayers Thought He Was Being Robbed

• Even assuming that the worst of the allegations against Ayers were true (and that's a big assumption), does that mean the police have the right to shoot and kill him in broad daylight on a public street? He could have had a kilo of cocaine on the front seat of his car and the shooting would still be unjustified. He was unarmed. No drugs were found in the car or on his person. He bumped an officer with his car as he attempted to get away from whatever he thought was going down -- and for this he deserves to die?? This should be a sobering lesson to many different sorts of people -- for you "Task Force" types out there, maybe it will remind you that you are not executioners. Make the arrest, make it stick, but unless you are under mortal threat keep that weapon holstered... I hope the members of the grand jury that gave the cops a total pass can still look at themselves in the mirror each morning.

• The cops that did this was not pros and cop knows that u dont go behind a moveing car , and they do not shoot hard core guys ,so no matter what they think the girl was doing they had noooo right to shoot any one , they do not even shoot people that are being chased ,so why did they shoot a unarmed man , he did not try to run over the cop behind him ,the cop run up behind a moveing car ,lack of trianing , man dont vase car ,no match , no matter what he was doing ,it did not give them the right to shoot him ...

• I knew Jonathan well he myself and the other deacon's at Shoal Creek were very close. If he had lead a double life I believe we would have known something.He had a young mens Bible study class every week,they were acountable for each other.It seems like the da used the word of a small time drug dealer and user that changed her story to get their verdict which was beside the point. Jonathan did not try to run over those cops,he thought he was being robbed as the emt's and the hospital staff told thay he said. Iwould like to ask the people on the grand jury what would they have done if it had been them.Iwould like to say that I'm a christian and I have the utmost respect for the law, but this was very wrong and an innocet man lost his life for no reason.He was my pastor and my friend,Iwill never believe that he was having an afair with anyone.Yes Jonathan came through Toccoa once a month on his way to Victory Home where he preached once a month, I'm sure the grand jury did't here any of this.Thank you Roger Shirley deacon Shoal Creek Baptist Church.

• Rev. Thomas is right. It's not just the infidelity to your pregnant wife; it's the diseases he could have brought home while tramping around with a coke whore -- all while preaching morality on Sundays. This is not how you treat the mother of your children.

• Mr. Thomas, I lay my head down comfortably at night, as well. But I also do it asking God for forgiveness for my sins for I am not perfect. We are all sinners, you included. As I said before, there may be RECORDS, and there may be INFORMATION, but there is no PROOF of any wrong doing. No one has given any proof of anything against him. If you will remember, Miss Barrett has given two statements - one saying that Jonathan was ministering to her that day and that he had been counseling her for some time, and then the other that she had been involved with Jonathan. The only proof that has been provided so far is that one or the other is not true. Let me ask you a question, Mr. Thomas - if we were able to obtain your phone records at this moment, would every call on there be to numbers listed to only men? I'm assuming that would not be the case - so, that being the case, do we now have PROOF that you are involved in illicit relationships with women? According to you, we do. Have you ever witnessed and shared your testimony with someone who wasn't a Christian? If so, we now have PROOF that you were involved with wrong doing, since, of course, you had contact with those people. Sunshine, we knew Jonathan, and God knows the truth, and that is all that truly matters. Jonathan's friends, family and congregation stand by his memory fully and unconditionally and without question. God Bless!

• I'm sorry, REV. Chad Thomas - am I misunderstanding, or are you passing judgement on Jonathan? I would think that a true man of God would be the last one to make accuasations against another man. Did you know Jonathan? If you did, then you would know that the people who support him, his memory, and his family have made no mistake. You should only hope that the people whose lives that you have had influence on in your position would stand for you in the same way if the need were ever to arise. Would they - beyond ANY doubt? • It is really said that there are people who can not admit when they have made a mistake and realize that the man stand before the congregation was exactly who the bible said they would be. • I'm sorry, but am I missing something? I did not see where K. Barrett testified at the Grand Jury. Did I miss a link? I also did not see any evidence that would convict Jonathan. I have not heard any evidence given by the police that Jonathan was doing drugs, having sex or anything else, except he was in the wrong place with a bunch of gung ho policemen who used the law to get off. I did see those so called life threatening injuries to the police and I would be ashamed to go the emergency room for those. I hope the taxpayers did not have to pay for that visit. The D. A. does not have any evidence that would support Kayla Barrett's claim and they only want to keep insinuating that because it makes Jonathan look bad. Give me a break. I hope she doesn't expect any help from the clergy again. As for the preacher who will not minister to females without his wife or another female present, I hope you can explain that to the good Lord, cause that certainlhy limits your ministering ability. The Ayers family should file a slander suit against K. Barrett and the D. A. I would also look at the Stephens C. hospital because they certainly took their sweet time getting Jonathan to the operating room since he had time to be interviewed by the police, talk to his wife and several other people.

There was an inmate who spent "383 days" in jail on a misd. charge without even once having the opportunity to appear before a judge to get a bond set.So don't tell me how honest and thorough a DA can be!!!!!!!! I was so deeply offended by the way officers manipulated evidence that I just decided to seperate myself from them.

• I'm not going to fall for your bait, and your attempt to change the dynamics of this case. That Grand Jury did not hear all the evidence, and this is the fault of the DA who controlled everything. The heart of the case is Ayers was NOT doing anything illegal, and these cops OVERREACTED! Its just that simple. I also direct you to the police story changing that went on that day. There will be a lawsuit in this case, make no mistake about it. I am sure at such time, a Jury will hear both sides. If at this lawsuit a Jury decides against the Ayers family after hearing both sides I will be happy. But I will NEVER accept the whitewashing going on here. And all the fancy words and catch phrases will never suit me! I am not anti cop, but you can rest assured that one day after more and more people suffer loss at the hands of murdering thugs like this cops, that the laws protecting bad cops will start to change and the playing field will be level.

So perhaps you might list all of the witnesses they interviewed including the witnesses at the gas station and the paramedics. Can you provide those names? If not, how do you know what the GBI did or didn't do? So Danny Porter didn't criticize the police and suggest things for the grand jury to consider for criminal charges as was reported by WNEG radio? Did WNEG make that up or are they part of this "coverup" also along with the "dishonest" jury?

• The Towns county situation did not involve police force. it started with a deputy that shot up his wife's lovers home. The dynamics here are no where near the same. In the Towns County situation if the GBI had not done something the press would have had them for dinner. I still contend the GBI did not do enough to get to the facts. As for as this "expert witness" goes, he is a hired gun that will give any "expert" testimony to anybody that's paying him. As for as Danny Porter, lets just say the Grand Jury did not hear both sides. And I can't wait till an honest Jury rules after hearing both sides.

By the way, this is the SAME GBI regional office that put the Towns County Sheriff and two of his deputies in jail and sent them to prison (the two that didn't kill themselves). I don't think they would risk their careers and freedom to "coverup" for a local drug enforcement officer. If you want to know for yourself, go get a copy of the GBI file and read it yourself. By the way, I looked up the "expert witness" online that testified in front of the grand jury. He is the same guy that the family of Diallo hired to testify AGAINST THE COPS in Amadou Diallo. I also read that Gwinnett DA Danny Porter went before the grand jury and pointed out some mistakes the cops made to the grand jury to consider whether they should indict them. It doesn't sound like a whitewash or coverup to me.

• I wonder what kind of deal they gave Barrett. She probably won't have to serve any time in Stephens co. for anything she has done. She might have to in Franklin Co. for the stealing she is mixed up in. This is a case of the law making deals to keep them out of jail. I don't believe Oxner got hit by Jonathan. I heard he has this problem of getting hit by cars..

• 1. Let me say for the record that I'm certain that mikeone is lying about having a source inside the GBI. If he had one, he would know the facts of the case and would know that there wasn't a cover up. 2. If Jonathan Ayers was "ministering" to this prostitute, then why didn't she know his real name and why didn't she know that he was a minister? During the interviews with Ms. Barrett - heard by the grand jury - she knows him as "Jay," and to her, he's just a regular customer. She did, however, pick him out of a photo line up and know what type of cars he drove, etc. 3. The cops saw more than "him helping her out" as mikeone has claimed. They saw money changing hands. They were investigating drug transactions and saw her in the car with an unknown man and saw money changing hands, so they had probable cause to suspect that he was buying or selling drugs, which means that they need to follow up on this guy. 4. The grand jury returned a verdict in only 20 minutes. That points to an abundance of evidence that the officers did not break any laws. All that being said, I feel deeply for all involved and hope that people can get beyond pointing fingers and accusing innocent people of cover ups that never happened.

• Guys, my previous comment was not an indictment of Ayers. Maybe I didn't make myself clear. My remark is mainly directed towards future pastors and church leaders. We live in an environment where accusations and rumors are all too often brought forward regarding church clergy and other church leaders, youth ministers included. Its 2009 and we're living in a different world then we did even 10 years ago. A friend of mine is a pastor and he will not counsel a female unless his office door is open. The church secretary is located close by. He simply wants to avoid any appearance of evil and/or wrongdoing. Please don't misconstrue what I am trying to say. I am not making accusations and I am not inferring Ayers was in the wrong in any way or respect. My remark is clearly aimed to the next generation of church leaders. Perhaps you're correct Pete that Jesus would stop helping women, but that was then, and this is now. The world has changed dramatically over the last 2000 plus years.

• I am getting sick and tired of people trying to infer Ayers did anything wrong! There is not a shred of evidence to support Ayers did anything wrong that day, NOT A SHRED!! If there was any evidence trust me the DA and the GBI would have released it. He did as I would have done! Remember that she had just had a miscarriage and was still suffering from the physical effects of it. He just stopped and helped her out! The cops saw this, and they saw him drop her off at the hotel. AGAIN, AYERS DID NOTHING WRONG!

• Lee, the pastor's been cleared of pretty much everything. He was just helping out a woman in need. By all accounts, he seems to be a stand-up guy, behaving truly as Jesus would by helping the lesser. I'm not sure Jesus would stop helping women like this just because he was worried about what people might say.

• I hope that the pastor was not involved in any unsavory activity. If that is the case. I hope these words I am about to use will help anyone in ministry. I don't think a pastor should ever be in his (or her) office, car, another home of a female without his wife present. It opens up to much rumor, speculation, innuendos and accusations. Ayers was a young man and pastor and perhaps he was still learning.

• Mikeone my family members are not anticop either we have respect for the law.But I can tell you right now I have no respect for this NCIS team.(None of them)Here is why I think Jonathan ran he was scared!A nurse that was in surgery with Jonathan came out and said he gave a statement to a police officer and told him he knew something bad was fixing to happen and he was just trying to get out of their.Kyle Bryant said they knew all the facts before they made a bust they had too.Well the only fact they had this time was according to Chance the only thing they heard was Kayla said Ha J so they assumed he was her drug dealer.And I suppose thats all they needed.Unless there is something else that we are not being told.So I think this team thought O.K. lets make a big name for ourselves.But it went horribly wrong and a young innocent man lost his life yes Jonathan did run but everybody that runs do they shoot them?I am a God fearing person and I do believe that they will be held accountable for their actions you can't just go around shooting innocent people.This team should be dismantled or Kyle,Chance and Billy Shane should be dismissed.

• sick relative I won't even pretend to know the heartbreak of losing a beloved family member this way. However I am the victim of police misconduct. Thankfully in my case a Jury saw through the crap and took my side. While most of my statements make me sound anti cop, rest assured I am not. In this area I am actually neutral, I will neither give the cop the benefit of the doubt or convict the cop right on the spot. What pisses me off is watching others do it either way. I admit I have seen and heard a lot of hyperbole on both sides of this Ayers case, but the worse of it is coming from the pro cop side. To me this is what happened. These drug cops were watching this girl, for how long I have no idea. They watched Ayers pick her up and they must have followed them to the hotel, and watched him drop her off. If they had any evidence that Ayers did anything anything wrong we would have heard about it by now! They then decided to go check out Ayers, and then proceeded to preform a felony type stop on Ayers, again an action NOT backed up by the evidence in front of them. We know that Ayers did not know they was cops because of the testimony of the EMT's that carried him to the Hospital. They said Ayers had asked them "who shot me?". When an innocent person encounters police whom are in the process of making a felony stop on them, in almost every case the person will comply, why then did Ayers not do so? He was innocent of ANY wrong doing that day so why run? Nothing illegal was found in the car or on his person, so again I ask you why did he run? This question along with his question of the EMT's that day goes a long way toward an insight into what his thought processes were! So what are we left with? In my opinion we are left with a bad case of miscommunication! Who's responsible for this? In my view both Ayers and the cops are. However there is another dynamic at play here. Why do the felony stop? They had no evidence Ayers did anything wrong! Why turn a penny ante case into a major felony stop with lethal force with no underlying evidence to support it? I have heard the pro cop arguments about Ayers using his car as a weapon. You can't with any credibility make this argument in view of the facts I just wrote about! Ayers did not know whom shot him, and he was innocent, innocent people don't run! again we go back to miscommunication, and in my opinion while Ayers shares some blame, the lions share of the blame in my opinion goes to the cops because they did not handle this the right way! I have spoke with several narcotics officers, and to a person when presented with all the facts, they stated to me that these cops failed to follow basic police procedure! They should have just left Ayers alone, or followed him and let a marked car pull him over. Then in my opinion there was enough probable cause to do a search of his car and his person. This is what almost every narcotics officers have told me they would have done if presented with the facts these drug cops had at the time. Ayers was in the wrong place at the wrong time. But because of bad police procedure followed by not identifying themselves properly led to Ayers death. Sorry I can't back the cops in this case. While I admit I wanted a Grand Jury investigation of these facts. I see now that putting my faith on my fellow citizen in this way was wrong, and any hope of a just finding was just a pipe dream. I don't claim to be a religious person, but I do believe in an omnipotent God! Ayers and these cops, this DA and the members of the Grand Jury will one day stand before this God. I hope you then can back up your actions! These Cops deprived a wife and unborn child of a Husband and Father with NOTHING to justify their actions. I wonder how God will feel about them and the people that facilitated the cover up?

• This DA will have his job for as long as he wants it. Trust me on this! Rabun, Habersham and Stephens County make up the Mountain Judicial Circuit, and the majority of the people in this District are conservative,in fact this is some of the most conservative parts of Georgia! I am sure that most of these people likely feel that Ayers was guilty as charged, and will back up this DA! In fact I see the DA getting more votes now. This DA knows this, and was placating his base with these actions. There is NO way these cops will be held accountable for their actions in the Georgia State Courts or the GBI. The only exception would be for them to murder the child of a powerful person in this area. Then this person would have them for lunch. Ayers is just some loser to this DA and these murdering cops, and we the people that's trying to hold them accountable are to them just smuck's.

• The grand jury didn't have time to read all the pages of this, and they only heard from the cops. They didn't hear anything from the citizens who saw what happened. • My best advice to the Ayers family is to do two things, both at the Federal level, abandon the State Courts you will NOT get justice in them. Especially any court in Stephens County. • There really is nothing in the Gainesville paper report that's not in the Toccoa paper, I posted the article above. What makes me sick about all of this, is the fact that its going to take a lawsuit to get to the bottom of all of this. • I will judge, and I will make said judgment based on the FACTS! First lets look at this Grand Jury Decision. I have not read the GBI report and only have been told the general aspects of it. The Grand Jury NEVER was presented with an opposing view of any of this report, like this one. This man was NOT a target, so why the attempted felony stop? Why did these cops decide to follow him like they did? They simply should have noted the tag number of his car and file it away. Then at a later date if he was seen involved with this girl, then make contact! In short they should have just let the guy alone! I seriously doubt the Grand Jury was presented with this side of the story. The DA controlled EVERYTHING that the Grand Jury saw. There is NO procedure for an opposing view, and unless the people on the Grand Jury have the good sense to question the DA and the GBI report the results will be as what happened yesterday. I hope the Ayers family hire a good Attorney and file the correct lawsuits, but PLEASE don't use the State courts. You will NOT get justice in them. • It sounds like there is a lot more to this than has been put on the internet. Fox 5 said the GBI file will be released Monday and I bet there are some surprises in there. I had a neighbor who was a cop growing up who was one of the funniest most outgoing and caring people I knew but he shot an armed robber in a bank and he was never the same after that, always seemed depressed. • I really don,t believe the grand jury will do anything either.Although I have talked to one of the witnesses that the GBI interviewed and his statement was not in their favor.In fact 2 who was interviewed gave the same account.So I can't wait to see if it is the same story now.I feel Jonathans name will be drug thru the mud and I can't even imagine what the story is going to be now.Their have been so many!!! • Sunshine, I won't add anymore about this subject then I have already. I will just say this. Wait till the Grand Jury has finished, and this whitewash GBI report is made public. I expect several aspects of this report will be redacted though. Also wait till this report is released and the people that was interviewed make their own statements. However its important to know that the GBI cleared those cops, and this Grand Jury review is a GAMBLE by the DA. There is a saying in the legal business that you don't ask a witness a question that you don't know the answer to, and a DA can get a Grand Jury to indite a ham sandwich. What this means is the person that does the presentation to the Grand Jury controls the process. Don't look for the Grand Jury to do anything, I am not expecting anything from them.

• Most Law Enforcement Officers do their duties and for the most part stay out of trouble. What bothers me is how they stick together when one don't. I have had this discussion with cops all over. To a man they say that this so called "blue line" is necessary. Cops are the only group of people that have arrest powers, and can effect your life with loss of freedom. I have no problem with this because of the training they have. It becomes a problem however when cops lie and slant investigations, when said investigations involve other cops. Its a built in conflict of interest, and this is wrong on many levels. The Grand Jury is a start, but ALL investigations involving cops should be handled by CIVILIAN review boards, with the authority to call for Grand Jury review as it relates to Law Enforcement criminal activity AND to take Job actions. Its also in my opinion important to have civilian's on the Georgia State P.O.S.T board. By civilians I mean people that DO NOT have a Law Enforcement or Government background. So that this conflict of interest can be removed. These cops should be indited and tried for at least manslaughter. However at a minimum they should lose their P.O.S.T certification so they can NEVER work in Law Enforcement in Georgia EVER AGAIN!

• I just got off the phone with a friend. This friend that is with the GBI has expressed their thoughts about this decision. Its clear the GBI report has cleared these cops. This friend said and I agree, that the DA's decision to send this to the Grand Jury is a gamble made by him. The DA and the GBI Agent's that did this investigation are trying to walk a tightrope. They decided to send this report to the Grand Jury as a way to "sanitize" it. The Grand Jury does not just "study" this. They decided based on what is presented to them. If whomever presents this to the Grand Jury is careful they can slant what's presented, and therefore slant the decision made by them. Then this DA and the GBI can then say "well the Grand Jury made their decision" and the case is closed. Now this is a gamble, if the Grand Jury balks at the "Official" line, and comes down on the Cops, the DA and the GBI have a major problem. Its important to remember this one point. The GBI agent's that investigated this all all wear badge's. They are investigating other people that wear badge's. So they have a vested interest in doing whatever they can to clear these officers. Also its VERY important to remember that the GBI and this DA are also trying to not only clear these cops, they are also trying to limit the State's legal liability. I am 99% sure there will be a civil lawsuit, and this is also part of the gamble being made here. Now let me say something else. I sound like I am anti Cop with my writings. I know this. However I am NOT anti Cop. What I hate is Cops that make poor decisions, then lie about it later. Deadly force was NOT called for here. These Cops handled all of this badly from the beginning. A law enforcement officer has an awesome arsenal of tools, and laws and years of court precedent to protect them from actions arising from their duties. I would NOT have it any other way. But when Cops chose to be reckless in their duties. Society needs some way to hold these said Cops accountable, and when cops are investigating other cops, and are slanting reports like the GBI did this one. • Margie I will go even further. I feel that the laws in Georgia needs to be changed. When a cop in involved in a shooting that results in a death, it should automatically go to the Grand Jury and someone from the State Attorney General's office handles it. Let the Grand Jury investigate! Having the GBI do the investigation is like having the fox guarding the hen house. I know there are honest hard working people at the GBI, I know some of them. However the temptation to slant an investigation is simply too much. I hope one day there is a big push to get this law changed. • OK, so the race card is off the table, but I had been given the impression that one of the officers present was Black, in fact you can see him in the earlier part of the Shawn Apostel video standing near either Harrison or Oxner. Oh, well informed guy. I know you have nothing to hide, can you confirm those names of the officers again? I have been in some split second decision making circumstances and been very publicly held accountable for it. The secrecy on this is what is really beginning to look incriminating. A secret report to a secret grand jury does not cut it either. I have to agree, this is not likely to result in a murder case, but it is looking like a manslaughter case. Likewise, the officers may have been following an approved procedure, but lets be honest about something, it takes a certain instinct to be able to tell the dopers from the doughy innocent looking guy wandering around in a bubble while wearing his "Jesus Loves You" T-Shirt. I mean, sure, we profile people, but I am trying to figure out what profile this guy would have been fitting. The cops in this situation simply were not exercising honest instinct, but the "lets scare the crap outta this guy" game which turned terribly wrong.

• An informed person, all I see with your comment is either a cop or someone that is pro-cop and see's no wrong in anything a cop does. This is precisely why a Grand Jury investigation is so needed. I still disagree with your findings, but will defend your right to have them. For the record, I wish I could support these cops, I am generally a conservative law abiding person. • I am amazed at how many people assume to know what happened and the normal race card people. Not that I expect you to know because you are more apt to believe the rumors than the truth. Race should really be no issue because everyone involved in this, Rev. Ayers, The Drug Dealing Woman, The Undercover Agents, all of them were white so give up the race card. I personally know the agent that was struck by Rev. Ayers, the agent that fired his weapon, and the agent driving the unmarked escalade. All three of these agents are top notch officers and are very well trained. The video clearly shows one agent being struck with the rear of the car and then accelerating forward towards the second agent. What would you do if someone was fixing to run over you with a car and you happened to have the ability to defend yourself? I truly feel for Rev. Ayers, his family, and his congregation. However, I also feel for all the agents involved. This was not a cold blooded murder in any way. I do feel that this could have been handled in a better way and some other steps could have been taken to prevent this or possibly change the outcome but none of you know or understand that these agents as well as Rev. Ayers had a split second to process what was happening and to take action. All of you have the comfort of arm chair quarterbacking this from now on. Have any of you ever been in a position where you have to make a life or death decision in a split second? When you have been in that position and done everything perfect without hesitation, then you will have the right to criticize these agents. Otherwise, stop with the conspiracy theories, cover ups, and corrupt cop accusations. They hold absolutely no merit and only cause more lies and rumors to get started that can only further harm the reputations and memory of all the people involved.

• mikeone: I, too, have a source inside the GBI, and I think maybe you were mistaken in your comments above. You obviously misunderstood what your source may have said to you. The case has been investigated by the GBI, but an investigation does not prove guilt or innocence. It is an accumulation of the facts which will then be turned over to the DAs office and will go to a grand jury. Your source may have expressed his or her opinion as to whether they felt the officers broke any laws, but the investigating officer does NOT determine if a person is innocent or guilty. There is no "fix."

• This was in today's (10-30-09) Anderson SC paper A report from the Georgia Bureau of Investigation into the shooting death of Lavonia pastor the Rev. Jonathan Ayers could be done soon, but a release of that report will take longer. Mountain Judicial Circuit District Attorney Brian Rickman said the report could be done in a matter of days. But as long as the legal process plays out in the case, the report will remain confidential, Rickman said. Once the GBI finishes its report, Rickman said, the agency will turn it over to prosecutors. Prosecutors will determine whether the report will be forwarded to a grand jury. If a grand jury issues an indictment, the report will remain confidential pending the result of subsequent legal proceedings against the person or people indicted. There is no word at this time about how long the legal process will take in the case. Ayers died after being shot by law enforcement officers on Sept. 1 at a gas station at Broad and Currahee streets in Toccoa. The law enforcement officers were conducting a drug investigation of which Ayers was not the target, according to statements from authorities. Its my opinion this DA has no intention to release anything but maybe some redacted parts of this report. Its like I said, the fix is in. Its going to take legal action taken by this mans family to get this out into the open.

• With as many eyes that are on this now I do not see how they will be able to continue to cover up all the lies that the NCIS Officers and The Stephens Co. Sheriff's Dept have told. Not sure if any of you know this but DateLine is about to step in. Rest assured that the footage is being analyized and is being looked at by many.
