When 73-year-old Kathryn Winkfein was pulled over for speeding in May, she wasn't exactly cooperative with Travis County, Texas Deputy Christ Bieze. She refused to sign her speeding ticket, then tried to head back to her car...
The deputy gave her a verbal warning, threatening to use his taser. But the codgerly grandma didn't listen. So Bieze blasted her not once, but twice while the 73-year-old woman was already on the ground. The footage comes from a camera mounted on the taser itself.
Winkfein won a $40,000 settlement in the case. After all, a cop who can't subdue a 73-year-old without a taser should have never been allowed on the job.







They should have awarded her $400,000! That cop was WAY out of line! How dare he over a traffic ticket for speeding!She doesn't have to "sign" it, they could have put it in the mail to her, just like you get when the cameras catch you running a light. What a POS he is!

Ok, I'm citing her because we tend to think the elderly are incapable of behaving badly.
Most of us will tolerate our elders being grumpier and more rude than the rest of us because, well, we think they've paid their dues, they're not going to be around that much longer, so, oh let's just let it go.
I actually agree. But not when it comes to everyone else's personal safety? Hellooooo.
She is old enough to know better.
I remember this case. This post neglects to mention that she had lied about her side of the story such that she was directly contradicted by the dash cam video. Oops.
The Taser video is a little like a picture of an inch of elephant hide labeled hippo.
But, I will say this, it does reveal her nasty attitude. Now that's some example for our grandkids, eh.
$40,000 is a nuisance payout. If this case had any real merits, it would have received a much larger award.
Age and treachery will triumph over youth and skill.
This wiley old woman sensed that she could turn this loss into a win. So she worked it. Oh, I can hear the outrage engines whining now. But wait! There's more!
She figured she could take the pain, it'd be quick. So she went for it. Maybe she planned to entrap the cop. I think it occurred to her while the moments ticked by.
So she went for broke. And it kinda' worked. At least her attorney got paid. She may have gotten half.
What? Entrapment of the cop?

This police "officer" is nothing but a government-endorsed thug. A Brownshirt. This is TERROR, not law enforcement.
This "officer" should be not only pemanently stripped of his gun & badge (and job) but should also be made to do a minimum of 500 hours' community service emptying bedpans for REAL veterans at the VA hospital.
THEN he should be court-ordered to pay her entire restitution from his own personal savings...not from the government funds.
Sure, teh $40K payout is "nothing" because it comes out of the public's pocket - but this "officer," clearly above the law - will feel NO PAIN when that "shut-up" money is paid.
The restitution is currently coming from taxpayer dollars, meaning that the woman is basically just getting a small amount of her own money back anyway.
This should be placed ENTIRELY on the officer's shoulders PERSONALLY. He should be stripped of his post and be sent to JAIL like any civilian in this country would be if he were to arbitrarily tase someone.
Just wait for a road-rage incident of a civilian tasing another. It will be assault charges and mandatory time.
But when a COP tases someone, well, that grandma clearly deserved it.

If my grandmother has defied a direct order from the police, and I saw the taped evidence of it, I'd: (a) be shocked that she'd behave that way, (b) wonder why she'd risk being Tased after being warned, repeatedly, (c) be publicly mad at the officer to help her save face, (d) then be mad at her privately and wonder WTF was she thinking.
The person responsible for the Tasing was the granny, not the officer. They clearly speak the same language and clearly the officer warned her repeatedly. SHE decided to find out if he meant it. SHE made the choice.
Of course, the police could still do it the old fashioned way and put her in an arm lock. Which would result in bruises, strains, possibly a popped shoulder. Oh, and lots of pain anyway.
Or the police should allow the offending driver to direct the traffic stop instead of him. He should let them decide when to comply, how to comply, let them verbally abuse him ad nauseum and let it go on until... until when Dee? Until lunch? Until the cop has racked up over time? Until the officer has to take a whizz or just when granny needs to? And then should he just follow her to the loo, waiting patiently outside until she emerges?
In fact, my Abuelita and I were very close. She would not have ever, ever, misbehaved as shown in the clip. She was a whole lot smarter.

This may be a side effect of hiring college grads with degrees in lieu of high school grads who actually had a real job or military experience before they applied. Of course this is a generalization and there are many cops with degrees who do great work, but we seem to have such a problem these days with cowardly cops instantly resorting to a defensive weapon, even when the "perp" is a little kid. Pretty pathetic.

I'm ashamed at the behaviour I see police engage in today. Once upon a time we were there to help people and comfort them, but these days they all have seen too many movies and act like cowboys.

Further she was born in 1873. why dont you look into what the us government was doing around that time... namely using artillery shells form naval ships docked in new york harbor to murder us civilians in riot. We have a great deal to fear from our government. And there are for more evil transgressions commited against us by our government than we will ever be allowed to know. So any time a police officer uses excessive force (something we usually know) We need to make a huge stink about it!

Ponder, actually yes, on more than one occasion. The most recent I totally agree the cop was totally in the wrong was earlier this year, I think, where a cop's son had been in some traffic dispute with a woman. The woman cornered the teen son at a convenience store and continued the verbal dispute. The teen son told his cop dad all about it. The dad cop met his son at the store and immediately drew down on the unarmed woman and her friends. Totally, totally wrong. There are other examples but it would take a while to list them here.
But I do not think bad cops represent all cops. Not even close. There are far more "civilians" being uncivilized to cops merely because the cops are cops.

It is just a certification that you received it and you will deal with it whichever way you choose (defensive driving course, fine, traffic court, etc.)
Regardless, this cop was outrageously out of line. I swear, the Travis County Sherrif's office is getting inhuman these days.

I'd hold him personally responsible and see him as the defendant in court. You're right, no one is above the law and neither is that criminal.

If I had a taser and threatened to tase you if you didn't do what I said, and then tased you because you didn't, you would hold yourself responsible for me tasing you? Just because this is a cop and people are supposed to listen to them doesn't mean that they are allowed to use "unnessary force" That would be like if I ran away from the cops because I stole a lottery ticket from a gas station. I certainly wouldn't expect them to draw their guns and shoot me dead over a lottery ticket, but I guess in your mixed up world that make sense, lottery ticket = 1 human life. He should have enough sense if he wants to get his point proven, he needs to arrest her, put the cuffs on her and take her to jail (gently because of the fact she is 73) She may be so hard of hearing, she didn't even hear him. Everybody knows that people that old are cheap and try to get out of paying anything they can.

2. He didn't sound surprised. The state you live in does not entitle you to be abusive.
3. Granny played the granny card. She failed to believe the cop when he warned her, repeatedly, that she would be Tased if she did not comply.
