Greentree Mortgage: Another Customer Says She's Facing Non-Stop Harassment From the Company

• You do not have to pay the bill collectors. You how ever have the right to set up a payment schedule with the company/group you have the original debt with.

• This is not the only company that harrasses. Someone claiming to be associated with Comcast is doing the same thing. They use a 866 number. Even if you are a week away from payment. These jerks call you. They will not leave a message on your voice mail. Many a time they only allow the phone to ring three times before they hang up.

• Yes, it is HILARIOUS when our country is going down the toilet and MANY home owners are losing their jobs/homes due to the horrible economy and families are left homeless. I completely see the humor in this situation! I cannot believe how many idiots are out there online that comment on information that know NOTHING about!

• Hello, I am from  Clarksville Tennessee and in the last 3 months our home loan was bought out by Green Tree also. We never had a problem with our other mortgage company and never was called unless a payment wasn't made by the 15 of the month . This company is rude and totally is violating our fair debt collection rights. Last month after one day of getting 20 yes I said 20 phone calls in a day I finally picked up the phone and told them that ii is against the law to call excessively.  Actually timed the calls and wrote them down and they were calling from different numbers everytime within 15 to 20 minutes apart. After telling them that I would file a complaint with the attoney generals office and the dept of finance and acccountability with our state the phone calls died down slightly. Like the hundreds and hundreds of complaints that I read on the internet I too start getting these called on the 2nd day of month. I  would like to start a class action law suit against them. I got cussed out this month. I called this so called Mr. Bradford this month and when I called him I told him  they are still calling excessively. They started calling again and it usually 10 calls that I am receiving before lunch. He also is calling my husband on his work number which I told them last month not to call.  He claimed he wasn't calling my husband on his work numbe and became irate with me and told me that if we would answer the da...d phone and pay our da...d mortgage then they wouldn't have to call so many times. Right there he admitted excessive callling.  So anyone interested in doing this contact me . T wolle let's take these corporate finacial giants down . Like she said they are a servicing compnay not a mortage company and when you have money problems they can't wait to take your American Dream away from you. I specifically asked them what do they have to do with my loan. they didn't say  they bought the loan but you know I am having  the same problem getting straight answers. t

• I wanted to refinance my second mortgage with greentree, after jumping through every hoop and furnishing them with all documents they requested, they never had the common courtesy to even review my documentation. All they did was send me a short note saying they dont refinance second mortgages. They are the morons that told me to go through the process in the first place. When I called they were nasty and very disrespectful and told me that they never told me they refinance second mortgages. Hell they are the ones that sent me the refinance package in the first place.

• Kristina, that sounds just outright evil. I don't care what your job title is or how much someone owes you...you NEVER say that shit to an 8-year-old.  Interesting Fact: Did you know that the Hells Angels and Outlaws never do anything or say anything to rivals families? There's an unwritten code saying  family can never see or hear their husband/father getting killed or beaten...Thus proving that these white-collared thugs have LESS decorum than hardcore criminals.

• i also have green tree and have been abused by them regarding being late. they even went as far as leaving a a message with my 8 year old that if I did not make my payment we were going to be sleeping in a tent. this last episode the manager told me I was making no effort in trying to resolve this situation. i was the one that called them to discuss payment arrangements. they have no understanding of the current economic situations or about their customers. as soon as this mortgage is paid off with them i am going to tell them where to go if not before!

• Your statement that you are afraid Green Tree will try to force you to buy their insurance is absolutely correct.  I went through a divorce and took over mortgage payments for my Ex.  The loan was not and is not in my name.  After sending a couple of payments Green Tree changed the name on the statement to my name and continued sending the bill to me. The next month they added an insurance premium to the policy.   I had purchased insurance and sent proof to Green Tree.  After three months of Green Tree continuing to add insurance to the monthly statement, and me arguing back and forth with them, I filed a complaint with the Attorney General in the state Green Trees main office is located-I think MN along with a copy of my insurance policy.  In the state I live it is illegal to carry two insurance policies on the same piece of property.  After involving the Attorney General, Green Tree removed all insurance charges and agreed to accept my coverage.  As soon as the Attorney General closed my case Green Tree once again sent a request for proof of insurance.  I again had my agent fax policy information to them and sent a letter with all the correspondence from them and the Attorney General threatening a lawsuit.  I've not had a request for proof of insurance since. To all who are fighting Green Tree, contact your state Attorney General and the Attorney Generals office in the state listed on Green Trees correspondence.    Use certified mail requiring Green Tree to sign for everything and keep all documents.  The Attorney General was the only party that could get a response and action out of Green Tree to solve my problem.  Don't give up and by all means possible call Green Trees bluff.  Green Tree is now claiming to be a "Servicing Agency" for  loans, a fancy name for a debt collector in my opinion.  Send a cease and desist letter to Green Tree telling them to stop all contact with you and anyone else they have contacted about your loan with US Mail being the only way they are allowed to contact you. I found a copy by goggling Cease and Desist letter.  It's been over two years and the phone calls stopped after the cease & desist letter. Do the research on line, know your rights and stand up to Green Tree.  Contact an Attorney if all else fails.

•  I just found out my BOA second mortgage was sold to GreenTree.  I have the same questions you do.  I also researched Green Tree and am horrified by what I am reading.  I scheduled my May 1 payment with BOA, not knowing my loan was sold.  On May 9, I tried to log in to my BOA account to find out whether the payment posted.  Iwas told my account did not exist!  I phoned BOA and was transferred 3 times.  No one could tell me that my loan was sold.  At this point I had received no communication or bill from Green Tree, but was told by BOA that "as a courtesy", they would forward my payment to Green Tree.  Today, 5/14, I received a "collection" notice from Green Tree stating I owed them $483.  After reading all of the terrible stories about Green Tree, I am afraid to pay them because I may not receive credit for the payment.  BOA can tell me nothing and Green Tree is not answering their phones. ( I assume because it is the weekend.)  I would love to fight back.  I always pay my bills on time and resent them telling me my payment is 13 days late.

• March 24, 2011 It has come to my attention through a recent experience and through research that Bank of America and Green Tree Financial specifical may be engaging in unfair and illegal lending practices and defrauding borrowers by luring them into believing they can assist the borrowers by altering the terms of their loans through government offered programs. If they are not illegal, then they should be. Let me explain. I work in Murfreesboro, TN and have for more than 20 years. I am writing you today to express my concerns over a state of affairs involving my residence in Antioch, TN. My husband and I currently pay two mortgages for this house. Recently, a situation has arisen involving our second mortgage that is causing great concern and anxiety that I would like to make you aware of. The second mortgage on our house originated in 2007 with Capital One. Shortly thereafter, it was sold to Countrywide, and eventually changed hands to Bank of America. On or about February 14, 2011, I was notified via written correspondence that I would no longer be sending my payments to Bank of America because they have retained Green tree Financial LLC as their "loan service provider" and all future payments are to be sent to them. Several weeks later, a similar notice arrived from Green tree Financial informing me of their position on behalf of Bank of America. The notification I received stated "Please be assured that as part of this servicing change, you remain a Bank of America customer. This does not represent a sale of your second mortgage loan – just a change in the servicing of your loan." (see exhibit 1) I have had loans bought and sold by different companies before but I had never heard of a "loan servicing company." Recent developments have caused me to be greatly concerned about these banking practices and compelled me to write this letter. To start with, I have never heard of a "loan service company". This is not my first mortgage, nor the first time I have had a mortgage change hands while I was still paying on it. This is, however, the first time I have been asked to submit payment to a "loan service company". What exactly do they service? How do they benefit me? What percentage of my hard earned dollar goes to the "loan service company" and what good or service am I receiving as a result? So far, the answer is a resounding NONE. The letter that was sent to me by Green Tree Financial stated that if I chose to pay by check, I would receive no invoice or receipt of said transaction and the cancelled check would not be returned to my financial institution. So, they are telling me to write a check to them, even though I do not owe them any money, and to reference only their account number on the check. Afterwards, they will destroy my check and any reference I might write on it that it is for payment of my loan which they indicated was still owned by Bank of America. Apparently, keeping a paper trail proving my payments is not an option with Green Tree Financial. Not only will Green Tree Financial not return the cancelled check to your bank, their letter indicated that it would be recorded as a generic debit with no reference that the funds were to apply to the loan for which I am still legally responsible to Bank of America. Also, the previously mentioned letter alledging to be from Bank of America was black and white (any correspondence I have ever received from Bank of America has always had red and blue graphics) and their letter stated ambiguously all future payments go to Green tree Financial under a different account number. Additionally, there was no mention whatsoever as to what these payments are for (i.e. mortgage) and the letter implied specifically that Green tree Financial does not own my mortgage loan, they are only servicing it on behalf of Bank of America. There is also a statement on this letter that we have a balance owed to Green tree Financial of $27,000.+ This is the balance we had with Bank of America, however, there is no mention that this amount is one and the same. Literally, it appears that we owe BOTH Green tree Financial and Bank of America $27,000. This is simply not true. My husband and I both work in law enforcement/criminal justice and have seen "questionable financial scenarios" similar to this before, and this seemed rife with "red flags". With these "red flags" in mind, I suspected fraud and immediately contacted Bank of America. I explained the situation to them and was advised there was nothing noted on their system stating that Green tree Financial services our loan. I was subsequently instructed to go to the Bank of America website, register, and make my payment online. I did so and my payment was accepted with the target date of March 1,2011. I was assigned the following confirmation number: 20110219223711P for validation; and I assumed everything was fine. A short time later, a written statement arrived from Green Tree Financial demanding our mortgage payment for February 2011. I became concerned because the aforementioned payment I made to Bank of America online was supposed to be the mortgage payment for February. Upon reading the letter further, Green Tree Financial stated that this was a "late notice" and "an attempt to collect a debt". To my knowledge, I have NEVER been late with a mortgage payment. I immediately called Bank of America to find out what was going on. They did not have an explanation but they did show that my loan was still on their books for $27,000+ but had apparently been transferred. I asked them for proof of the transfer and they told me that they could not provide that information. I asked them for proof that the payment I had set up online was indeed canceled and they could not provide that information either. They gave me an address and a fax number to send any requests to stating that the request had to be in writing. I faxed the request. I can't remember if it was before or after I sent this fax but I started receiving phone calls left on my answering machine from Green Tree which identified me by name and stated that they were a debt collector calling to collect on a debt. Every day that I came home from work, there were numerous missed calls from Green Tree. Early Saturday morning of last week, I was contacted by Green tree Financial via telephone demanding payment. I, in turn, demanded an explanation. The Green tree Financial representative advised me that they were now the "loan service provider" for Bank of America and I had to submit all future payments to them. I further inquired about the statement on the invoice stating that they were a debt collection company and that the correspondence was an attempt to collect a debt. They told me that my February 2011 payment was "late". I was also told that due to federal regulations, Green tree Financial was obligated to print that statement on all of their invoices, and to state it in all phone messages but that Green tree Financial is not a collection agency by any stretch of the imagination. They wanted me to authorize a payment over the phone. I told them I was waiting to get confirmation from Bank of America that all payments sent to Green Tree would be credited against my loan balance. (I have faxed my request to Bank of America 4 or 5 times, once from their branch office in Smyrna, with no response.) I also advised them that I did not set up bank draft payments. I have since been informed that if I do choose to make payments online or by phone, I will be charged a $12.00 processing fee. A $12.00 processing fee? Let me understand this clearer: if I don't allow Green tree Financial to auto draft funds out of my bank account and I wish to manually make a payment, I have to pay $12.00 each time I do so, and I am legally obligated to pay them each month? To the average layperson, this would seem like extortion. There were several days that our home telephone received non-stop calls from Green tree Financial, sometimes three to five times a day. They have left rude messages on our answering machine and when asked to cease, they first stated that they would notate on my account not to call. The next time they called, the "lady" told me that they would not honor my request to stop calling my home phone but they would stop calling my office. The third person I talked to said that there was no notation in my file that I have ever asked them to stop calling. During my fourth conversation with them today, they stated, that "we can call you anywhere, anytime, for any reason and there is nothing you can do about it". They have also called my work. Yesterday, I went t o the Smyrna Bank of America branch office and talked to an officer. As I sat in his office, he called Bank of America Corporate and asked them to check the computer for the status of my loan. He inquired on my behalf as to whether or not Bank of America still owns our mortgage. They told him NO, that my mortgage was SOLD to Green Tree on Feb. 7, 2011. (In my first conversation with Green Tree I was told that they did not own my loan and that they had no information on my account until it was transferred for servicing to them on March 1, 2011.) The gentleman whose office I was sitting in then called Green Tree and asked them if they in fact had bought my mortgage. They said NO, that Green Tree does not buy mortgages. It seems that none of them know what they are talking about, yet I am supposed to blindly send them payments every month or have my credit destroyed and face astronomical fees assessed to my account. So, as of March 22, 2011, have no idea who the lien/note holder is on my loan. I have been told repeatedly that Bank of America is the lien/loan holder for my mortgage. As stated previously, Bank of America states the sold the lien/loan to Green tree Financial. I requested a copy of something in writing verifying that the loan had been sold received no response. I further requested during the phone conversation made from the Bank of America branch office to Green Tree Financial verification of the legal agreement between their company and Bank of America which legally obligated me to pay Green Tree. I was told it was none of my business, that it was a private contract between two companies and I had no right to see it. After further questions, he gave me an address to write to request the document but he said that he seriously doubted if they would respond favorably. For the record, the Green Tree Financial representative I spoke with was named "Scott". The Bank of America official heard the conversation on his speaker phone. To date, I have spoken to several representatives of both Green Tree Financial and Bank of America. I have faxed written requests to both for validation of our lien/loan holder and verification of payments made/balances owed and to whom. I have received no additional information to simple questions, which I feel I have a right to have answers: Who is the lien/loan holder to our mortgage loan? The Note that I originally signed specifically states that I am to pay the lien/loan holder. I don't know who that is. I have done so every month without fail and attempted to do so for the payment due March 1 (or Feb 28 depending on which bank is right. Do we owe Green Tree Financial and Bank of America both $27,000? According to statements received we do. Why does Green Tree Financial insist they did not purchase our mortgage and are only a "loan service company" and Bank of America insist that they sold our mortgage to Green tree Financial on February 7, 2011. So far neither party has been helpful or informative in assisting us, yet, we are obligated to pay them as instructed with little or no recourse. Here's another kicker. Our deed lists Capital One as the lien/loan holder. Since this mess began, I have researched Green Tree Financial and discovered THOUSANDS of complaints that have been made against their business practices. (see attached) I have been horrified at some of the claims made by other "customers" against them, some very serious criminal accusations. Furthermore, I have been to the Register of Deeds Office here in Nashville to get a copy of the deed to the house in question. When asked why the deed still lists Capital One (the original lien/loan holder) as the lien/loan holder, I was informed by the official that the State of Tennessee does not require that lien/loan holders disclose to the municipal government when said lien/loan is bought or sold or changes hands. Yet, once again, we the homeowner (or debtor) are expected to make payments regularly and without question. When we do question, we are told we have no right to ask such questions. To make matters worse, there is the possibility that the law allows these companies to strong arm and harass people and are not accountable to us (the consumer who is paying them). I know that fiscal responsibility and accountability are important. Both my husband and I are public servants who are accountable to the citizens. We understand and abide by our ethical obligations. We are imploring you to do something about this incredibly unethical situation. I don't feel I need to tell you how disheartening it is to hold yourself to a high standard and try to do the right thing when large corporations, whom the taxpayer saved from the brink of extinction three years ago, are now engaging in the very behavior that created the banking crisis in the first place. In all honesty, banking crisis aside, these types of business practices are just plain wrong and I am confident that we are not the only ones who have had to deal with situations like this. What gives these arrogant companies the right to treat us like this? We only owe them money that they basically shoved down our throats and begged us to take in 2007. Our children are fighting and dying to defend our country from Al-Queida when it is likely that our worst enemies are the greedy businesses who prey on us here at home and abroad. They are the ones who give us a bad name and make other countries hate us. How dare they treat us with such disrespect and arrogance! They treat us like chattle and buy and sell our homes and our lives like barrels of oil, while telling us it is none of our business. When I read the complaints I discovered in my research, I couldn't believe that this type of thing happened in America. I had never heard of it before probably because Green Tree mainly worked with borrowers who lived in and bought mobile homes, borrowers who were in a different economic class than I was in. Their practices did not affect me and so I may not have believed these stories even if I had heard some of them before. I admit to being skeptical at times and to giving banks the benefit of the doubt. After all, they always seemed to treat me fairly. I now recognize my own arrogance and feel ashamed that I have not known of the plight of so many in my own country who were victims of banks and their cohorts who were "too big to fail." Rome was not too big to fail and neither are they. It is my fervent hope that they do not bring America down with them. I believe that I have found myself in this situation because I responded to a letter (one of many) I received from Bank of America telling me that I may qualify for a reduction in my loan and to refinancing my mortgage at a lower interest rate because Uncle Sam wanted to help them help me. I now realize that it was a farce, a fishing expedition to identify any loan holders that may be facing financial difficulties. I don't believe they had any intention of ever helping me. For my part, my financial situation was adversely affected through no fault of my own and I thought I would be foolish not to take advantage of the opportunity to lower my payments and interest rate. Little did I know that they would then assign my loan (or sell it) to a company that specializes in helping financial institutions deal with "troubled assets" by the use of creative tactics which involve high levels of "personal" involvement with borrowers. Their web site is so sugar coated that I was even lulled into a false sense of security after reading it. Then I tried to sign in and schedule a payment online and was instructed that it would cost me an additional $12.00 per month to assist them by lowering their need for more "personal" involvement, postage and paper bills. From my research, I suspect that the next "service" they will attempt to provide is to force me to pay them for additional insurance. I strongly feel that it is a conflict of interest for a loan "servicing" company or a lien holder to force insurance on a borrower which makes them the beneficiaries. In some instances, would it not be to their advantage to force borrowers who are having trouble paying their mortgagees to buy life insurance and to make Green Tree the beneficiaries of those policies? At that point, should the borrower die, they get their money even if the borrower has no equity in the home. This may sound a little extreme but pure unregulated greed knows no bounds. We need to combine our efforts and fight back. United we stand!

• We don't even OWE Green Tree, my nephew and his wife have a mortgage through them (we are NOT on their mortgage!), yet we get all the phone calls because they don't have their number. The number they call from is: 1-678-337-7663 from someone named Jacquelin (Jaclin?). I've told her time after time they don't live here and I'm just his uncle and don't owe the bill. A few weeks later, I get another call from the same person. IT JUST GETS OLD.

• Greentree is harrassing me. I lost my business, and I had my mortgage go from $749 to $1,264., because they paid my taxes, I could have worked something out, but I was given no choice. My attorney dropped the ball. I have paid every month this higher mortgage without a job and my husband on disability. Sometimes I'm late, but I haven't missed a month in a year since it went up, but they will call me all day if I don't answer the phone, then once they talked really rude to my daugther when she answered the phone and she said maybe you want to talk to my mom about her business, he told her he told talk to anyone he wanted to about my mortgage because I was late. This month I was late, and trust me I didn't spend money on Xmas, I bought nothing, not even for my two new grandbabies, which didn't feel good. Anyway when I told them I would sent it in a few days, they told me they were going to foreclose, because I didn't talk to them and I only had 4 hours to get the moneygram in, well I borrowed the money and got it in. I was call within 2 days to be told I have a new rep. and that he didn't believe that I really wanted my house in so many words, because I missed my due date and that it wasn't going to be acceptable anymore. Not personal, just business and hung up. Once I was told, if you want to talk to a higher up, that they would be ruder than they were, I said I'm sure!!! Nobody wants to be late with Greentree or any other mortgage co.

• It really piss me off to see people have so much negative comments to say about someone not being able to pay there bills. By all means I am glad that you can, but keep in mind that there are some people that are less fortunate than you. Lets be honest, who doesn't want to pay there bill on time? We all want to pay our bills on time, so for all you smart asses you need to think twice before you speak. Green Tree does not have the right to treat people they way they treat them! Bottom Line! They have to come up with a better way to deal with people. Calling people's house,jobs, family members, etc, is not going to make it any better. I hate Green Tree and I would not recommend them to any one!!! Let's continue to fight for our rights!!!

• yes! i have a complaint also of harassment from green tree calling my husband harassing him at work saying they were going to turn it over to collections and different thing that we were a month behind and it wasn't yet and he had sent the payment in the mail and that still wasn't good enough they still threatened him until he gave them a account number they just try to bull people i them to take over our account that was between them and country wide wish they had chosen different companies . bank of america bought out our 1st mortgage and our payment had never been late but a few months after they took over we got foreclosure papers in the mail we had to get that took care of now we get papers wanting us to turn our keys over to them and they would buy back only what we owe on the note NOW where do they think we would go my husband told them no that we had already paid 14 years on the house so NOW were getting papers wanting us to refinances or sign papers for modification we sent 3 sets of papers back unsigned and told them to stop sending them that we was not doing that either so to those people saying pay that mortgage you pay your mortgage and they still harass you but to the people that their hours get cut it is easier said than done its not like they dont want to pay it their doing the best they can but i really hope your hours pick up and pray the best for you

• @allen..........they have NO right to harrass you from either your family or your friends. . @Debra.......if the last day of the month they allow you to mail it in is the 15. then the day they pull it out of the bank should then be the same day. . . as for everyone who has trouble with GT. I have to agree with Wanda Mclean. . even after it is dealt with. keep a eye on them. they still may pull shit. . Palladium Holdings is pulling simular shit as well. they signed a paper giving up any and all rights to a house I know of. but they still have their name on it for paying taxes on it for some reason.

• someone help with this company.i became disabled and we fell behind a half of a payment and made arrangements to send a little extra each month but still the threatning ph calls come like you got 72 hrs to get out so like so many others we just dont answer the phone.can someone out there please take this finance co to the cleaners.greentree sucks ass.

• I have just been going through the same thing i am 2 months late and i get paid every 2 weeks i tell them i can make a payment on the 6th of January and the idiots are to stupid to say ok and take it. they called my mother telling her is my phone out of order and then my neighbor because we wont answer the phone i told them to only talk with me and the one lady just would keep calling and rude when my daughter who answered the phone who is 11 she told the caller my mother just said my dad wants you to only speak with him. the caller in return i don't want to speak with your dad i want to speak to your mother. again my wife stated my husband will speak with you that is when the caller said listen to your daughter and answer the phone. i have never heard such abuse and bad business tactics in all my life

• I am having the same problem with the bastards! They are the worst finance company I have EVER been with. I am in the process of turning them in. They had the nerve to call my place of employment and ask to speak to my manager! I won't rest until I haven made every complaint to everyone that I can about GreenTree Mortgage!

• I have had mortgages since 1994. I have never even come close to foreclosure. My mortgage is due on the 1st and I always pay by the 15th. As long as I pay by the 15th, I incur not late fees (I think this is traditional with mortgages). I have done this FOREVER, with every mortgage company. This is because the way my pay periods fall, it just works better for me to pay by 15th. National City Mortgage sold my loan to Greentree last Oct. OMG!!! Ever since then I get sooooo many calls, every day, starting on about the 5th. It's ridiculous and they use multiple 877 #s so make it hard to block. Most of the calls are a recording telling you to call them. Sometimes the calls tell you to hold on and make you wait. I didn't call them in the first place so I am not going to return the calls or hold on to speak to them. Last month a woman at GT told me that I could set up with them to pull my mortgage pmt from my checking account every 15th of the month. She said there would be no calls as long as this was set up. They sent me the paperwork, I filled it out and sent cancelled check & they returned the form and said the latest they can pull is the 13th of the month. Their employees are CONFUSED and giving bad information. So, since that form didn't take, here I am again, getting call after call after call to my cell. They consider my payment late if not paid on the 1st. NO OTHER MORTGAGE COMPANY IN 15 YEARS HAS EVER DONE THIS TO ME. Bad business practice. I would refi if I could, just to get rid of them!!!

• They have tacked on thousands of dollars on what we owe on our house, it just keeps going up and up. We can't contact them because we had to file chapt. 13 bankruptcy 2 years ago to keep green tree from forclosing on our house. We were a payment and half behind. I can go on and on about what these people have done to us. Lets get a lawsuit going on these people! From what I am reading all the time they have hurt tons of peoople. I know they owe us alot of money, what about you?

• I no someone going thought the same thing. this is what everyone shouuld do -Make a complaint to (HUD) -Get in contact with your (STATE ATTRONEY GENERAL) MAKE A COMPLAINT -Contact your local (Hud Approved Housing Counslor) there is alot of help out there for struggling home owners. U will be surprise whats out there so let every body u no that has a problem with greentree or any other lender what they need to do. I no that if they get enough complains about GREENTREE are going to get great results. So everybody Pleasesssss do what i suggeted ASAP Oh ye those of u that r doing the loan modification make sure that its been did correctly go to the web site MAKING HOMES AFFORDABLE it will tell u everything that thy should have use to determine your new payment check it out. Do this to make sure your payment is low as it should be. Remember we are dealing with DISHONEST PEOPLE.

• I have a mortgage thru Greentree and have gotton behind due to Okla. extreme weather conditions and then the Tulsa area losing 5 of their biggest companies in the last few months, also allowing outside contractors to come in and undercut what work was left. The trucking companies are going to East coast brokers to cut rates here in our area and won't use the Okla. certified contractors of their home state. Greentree has called as high as 20 times today on Sunday the 28th. This is every day till I can make a payment. Then they will start again tomorrow because I'll still be behind even thou I tell them when I can make the next payment. I even had one girl tell me that they would take my house because I only owe $12000.00 on a $80000.00 house. see how I like that. Hope this helps someone else know that they are not the only one being harrassed. It has just about made me sick.

• get a cell phone that will only allow calls from people in your contact list. turn off home phone. keep paying and documenting. You also have the legal right in most states to be notified by mail only. I used to do collections. CHeck with your local BBB or Consumer council.

• After a lifetime of paying my bills on time I have come to the following conclusion, post bail out. You have no obligation to pay your bills to creditors. They took a calculated risk to make a buck. If you don't pay everyone involve still gets paid and if things get too bad they just buy enough politicians to get a bail out. The only factor in paying a bill is if it is in your best interest to do so. If you have problems paying your mortage you may want to consider not paying. Put the money in savings each month and drag out the eviction process as long as possible. When you finally have to move you can probably rent a much nicer place due to the drop in the market and your rude ass mortgage lender can have one more unsellable piece of property. My 45+ years of life I thought paying what I owed was the right way to live, I now say look out for yourself, no one else will. Your lender has all of Washington looking out for them but no one is going to mail you a bail out check when you need it.

• This is horrible. I had a really bad experience dealing with Toyota, similar to this. I would see if there is any lawyers that can help you. It is against the law for them to harass you in that way. Check if there is a legal aid in your area, they are low to no cost.

• They're calling me AFTER they've received the payment, and after an hour on hold with various supervisors, they're telling me it's because they have a "system problem" and it hasn't been properly applied yet, so they can't tell me whether I have a $200 over-payment or am $600 behind. This should be sorted out, they say, "within a couple of days." They also auto-enrolled me in the "Home Affordable" Program because I *requested information* about it - didn't send anything in, didn't sign up, didn't agree, just ASKED, so they've changed my payments all around, some of the escrow's not getting applied properly, etc. They keep telling me it's all been sorted out, yet it's still a colossal mess. My payment is usually about $1350. The "Home Affordable" information said I could expect it to drop to about $1250, which wasn't enough to make the hassle (and, frankly, risk, based on what I'm hearing about the process) worthwhile. I continued to make my $1350 payment, though I was running late. They, however, continued to send me statements saying my payment is $920-some. When I inquire, they say it's because I'm enrolled in the HAMP. I point out that I am NOT, and even so the HAMP info said the payment would be $1250, not $920. They're not applying the extra money in my payments to the principle, no two customer service agents or supervisors I talk to can give me the same answer. When I received a nasty phone call about the "late" payment and told the caller that the payment has already cleared the bank and I've been told by two supervisors that there's a problem with their software that should be cleared up in "a few days," he said nastily, "So you're saying it's OUR fault that you're not paying your bills?" Most of their agents have been polite and professional, but their entire system is whacked. I was happy with the mortgage servicer I had before this, and they "reorganized" and sold it to this bunch of clowns. Can't afford to refi with anyone else, have to try to deal with this clusterf - mess and hope it doesn't ding my credit.
