Thomas "Tommy Shots" Gioeli, acting boss of the Colombo Family, suffers from diabetes and and heart problems. He's also suffering from the Spartan lifestyle of jail, where he now sits accused of murdering five men dating back to 1991...

So back in October, his lawyers went to court asking that he be released until trial. Jail, it seems, was much too harsh for a 57-year-old man in his condition.

He didn't have a toenail clipper, his lawyers told a judge. His mattress was too hard. He only had a spoon to eat with and feared a broken dental bridge would cause him to choke. And don't even get him started on the food.

The Brooklyn jail served way too many potatoes for a diabetic. "They're giving him rice and French fries with his hamburger," his lawyer told the judge. "It's just not a proper diet for someone with diabetes."

Surprisingly, Judge Ramon Reyes told the feds to look into the situation and report back, otherwise he might consider releasing Gioeli.

So the feds did just that, though not in a way Tommy Shots would approve. They began to monitor what Gioeli bought at the commissary, which doesn't quite speak to a man worried about his diet.

On November 13, for example, Shots bought Cajun hot snacks, doughnut sticks, six Hersey's bars, Honey Nut Scooters, Pringles, sour cream and onion chips, Ritz crackers, a Snickers bar, three pouches of Spam, six packets of tuna in sauce, five turkey and Swiss sticks, and six packages of Velveeta macaroni and cheese.

Two weeks later, he made a similar bulk purchase, though he upped the count of Hershey's bars to 10.

The findings would seem to put an ending to Gioeli's squawking. But his lawyer, Adam Perlmutter, who knows he's getting paid by the hour, refuses to halt his endless petitions over Shots' treatment.

He now says his client was buying gifts for less fortunate inmates during the holidays. Unfortunately, Mafiosi are known more for stiffing waitresses on tips than they are their generosity. We doubt the judge is going to go for this.
