Jennifer Daugherty, Mentally Disabled, was Tortured & Murdered by Her 'Friends'; 6 Arrested

Oh so this is another epidemic torturing and beating the mentally disabled which is about as bad as doing it to a child. So I hope the charges pile up and up till these people never see the light of day EVER again. And mabye as a added bonus have a couple people locked in a room with them getting more creative than they were with household appliances. Btw none of them must have been very bright, having her write a suicide note after the circumstances she died from?? Must be some of JR's freinds.

This is one of the most disgusting things I have read in awhile. I cannot understand the mentality of this group of misfits. What makes it so horrible is the number and age of the people involved in this. I cannot fathom 2 people doing something like this to anyone , but 6? Just like a pack of filthy hyenas.How big and tough they must have felt while they abused and humiliated someone not able to defend themselves. Yeah , you're all a bunch of big tough thugs.

Yes this is exceedingly horrible. A heart that can afflict someone incapable of defense, just because they can, well...
pure wickedness. Everyone is calling for justice with vengeance. A society that says there is no right and wrong is clearly saying there is a right and wrong now. In fact, society is saying there is a judgment for evil now. This is a visceral response, because we really know deep down there is a right and wrong, and judgment for evil doers. Yet when this blows over, it is back to an intellectual relative morality for us. Yet who could survive seeing his entire private life displayed on a movie screen for everyone to see? Deadly shame: another proof of our deep embedded knowledge that there is righteousness, justice and judgment to come.

It really doesn't surprise me when I see the picture of the defendants. How terrible for her and her step-dad. I hope these people rot in jail, but i am sure several of them will be back on the street in less than 5 years to do more horrible stuff. It is just the nature of our lax criminal justice system.

This whole story sickens me. How anybody could be so cruel, is beyond me. These people, if that's even what we should call them, are nothing but SICK, GARBAGE, PSYCHOPATHS! You would think that one of them would have put an end to this, or at least went for help.And what the hell is wrong with the neighbors? They said they heard what sounded like a body being slammed to the floor, and a violent fight followed by a woman's screams. Did anybody even think of calling the police?

But, our justice system will handle all of that for Jennifer and her family. I truly hope that these individuals get what they deserve, and that is DEATH! Everyone one of them should be sentenced to die. I don't care how much each of the six participated. They all played a part, and nobody tried to stop it. All six of you SICKOS are GUILTY!! Then, we need to deal with this Judge Pezze. One of the defendants, Ricky Smyrnes, had a parole officer that asked this judge to put him back in prison. She ordered him to anger management. She actually cut this guy a few breaks, which in return , kept him out of prison. This man doesn't need anger management, he needs to be sentenced to death. And you, JUDGE PEZZE, need to be REMOVED from the bench!! I'm so angry right now, but I would never go out and beat, torture, or kill anyone. That's what this group of monsters did, because they are sick, twisted, pieces of trash!!! God bless this family, and may they receive the justice that Jennifer Daugherty deserves!!!!!

I am from the Greensburg area. The rumor going around the town is that the victim had intercourse Angela Marinucci's boyfriend. The initial acts were to get back for the act.
That rumor being said I can't wait to see them try to appeal the death penalty.

See, this and the Dorothy Dixon story are what comes of letting mentally disabled people too much on their own. I have a mentally disabled cousin, so I guess I know a little bit. I mean, I know they're adults physically, but that doesn't mean they're mature. And currently the family was simply working on getting Jennifer some independence of her own. Like on this fateful day when she was going for a doctors appointment in a small town and staying the night with a freind.
I thought, as I'm sure the rest of the family did when they moved back home Jennifer would have been safer in a small town near where she grew up, than in a big city.
Obviously evil can be found any where at any time, the rest of us just have to hope we are not "in the wrong place at thed wrong time".

Lets look at the situation. 1 There were 6 people that abused a helpless person and because of their abuse ultimately caused her death. 2 No one here is suggesting to abuse these 6 people by torture. There will not be 2,3,6,9, people of authority attacking each one of them and abusing them to death. The Death Sentence is not abuse. However for these 6 people to end up in person, they will be tortured to the point that they will wish they were never born. They would be better off being sentenced to Death Row. I have a granddaughter who is autistic and very trusting. I pray noone like this ever gets there hands on her or her friends. This is so sad,and I can't beleive that it happened so close to home. I live only about 30 minutes from Greensburg. I just don't understand how people could be so cruel,there isn't even a motive. It seems that they just did it for fun. How disgusting. The real kicker for me is that I knew Ricky Smyrnes a few years ago,when I was working at a personal care home. He lived there,and had some mental health issues,but seemed pretty stable at the time,although having somewhat of a temper. I even would sit and talk to him,and his girlfriend who also lived there. He was one of my favorites there. It is creepy knowing that I had daily contact with somebody who went on to be a murderer. I hope that all of the suspects get locked up for good. There is no excuse for them doing what they did to that woman.

You know this is indeed a sick and twisted act. I knew jennifer and she was the most innocent and loyal person I've ever met. Shed give you her last dollar, literally, and the coat off of her back. It would be nice if the judges and police officers in the courtroom to turn a blind eye to what needs to happen to them all. How come they didn't pick on someone like Arnold Swartzennegger? Could it be that they can logically reason that he could fight back. So they can reason and use logic. Would you trust these people with someone weaker than them, like children. What about the elderly in a nursing home?

I grew up in the Greensburg area and this type of thing is very much out of the ordinary for the town. The news story here (Pittsburgh Area) was that most if not all are not from the immediate Greensburg area. There is talk by the DA for the possibility of death penalty for some if not all of these "people". I would not say I am a whole-hearted proponent of the death penalty but if anybody deserves and express trip to a deeper, hotter part of hell, these "people' should be given a ticket.

It sickens me how through out time human beings can gang up and single out one another like this like birds do. It starts like these stories of bullying we read about at a young age. You have your ringleaders and then you have these easily influenced kids trying to fit in at all costs. Or fly under the radar all toghether. Then you have poor kids like this one who had all that to deal with.Compiled with a mental disibility.They did all these things toghether ,some who may not have done it otherwise still participated. None of them look very bright and most of the actions proves they are'nt. Its just sad this girl had to lose her life this way as well as the handicap woman in the other story similiar than this, such cowards to treat people this way. But alas, there is a method to the madness hopefully somewhere out there and karma and fate will balance the scales once again.

What they did was evil, despicable, and unimaginable for most of us. However, they too are God's children. The enemy would have us hate. Love instead.

My heart goes out to the girl's family. We'll likely never know or understand why this happened. I know this, though. While she lived, that girl brought a measure of joy and love to her family that most families will never experience. That she is mourned is a demonstration of sorrow for the loss of the world and the loss of innocence. It is the loss of a spark of beauty and light, and while she is gone, her memory will go on. There is little doubt that she's already touched more hearts in death than most of us will ever touch in life.

May she rest in peace, and may her family find the same.

I have a sister (40) and daughter(18- has an IQ of a 12-14 year old as well) both are special needs, they do not ride on strange buses and walk the streets alone, they work at a workshop for special needs, attend special Olympics, then go directly home..... The out -side activities are with councilors, which include dances, shopping, etc....
With having caseworkers, FLP coordinators and councilors who stay on top of these cases, it is very difficult just to place atypical adult
out in the world unless they have evaluations to make sure they are competent enough to live on their own...

Lets just say, I may live in a small community, but we all the resources out there to help those in need.
And this idea that atypical adults are emancipated... This is why they have such a thing as "Durable Power" to protect them from the out side world.... this is not a cure-all but it does help for medical and placement factors and helping a atypical adult make correct choices and decisions in life..

I hope they will all soon be in HELL where they belong!!!

This is horrible, but what is even more horrible is that even if Jennifer's stepfather wanted to, she is an adult, and under Pennsylvania law, the mentally ill are given the same rights as someone who is not mentally ill! I know of mentally ill people who have driver's licenses, and drive cars, much to the consternation of their family members, but until they kill someone, nothing can be done! Read the MH/MR Act of 1976, and you will understand better why you cannot "protect" a mentally ill adult.

I knew Jennifer. She was a great person. I dont think I ever saw her without a smile on her face. All she wanted was to have friends. She was just to trusting. She really was very friendly. Oh god this is horrible! These people, and anyone else who harms a mentally disabled person, deserve to be shot. Or to be tortured themselves. This is sickening, makes me think twice about humanity...

As close friends to Jenn my family and I are saddened by her death. The only thing I would like to add is that I hope people start to realize how relaxed our judicial system has become and start to push for the death penalty in more cases such as this. I feel if we start "killing off" the bad seeds criminals will most definetly think twice before committing a crime. As for the christian people who feel the death penalty is to harsh, I would like for you to take time and read the details of Jenn's murder over and over, then imagine it was your sister or friend. I am not a religious man but even the bible says eye for an eye. Look back in history 100 years or so, criminals were hung for as little as stealing, and they were hung in the middle of town so everyone could see what would happen if they commit a crime. Now I know that public executions are extreme, but if it didn't take years to fulfill a death sentence criminals would think twice about it.

I feel sick to my stomach when I read this story. I had to read it over again because I could not believe what I had just read. Jennifer did not do nything for them to treat her this way. I don't think there should be a trail. That is a waste of time energy and money. Jail is too good for Robert,Ricky,Melvin, Amber and Peggy. I say put all six of them in a room and let them die a very slow and painful death. Some people are just bad seeds and there is no other way to put this. You can say it was something in their past or whatever you want to but they do not deserve to be on the planet earth. Some people you try and understand what went wrong but with the six people in this story I don't think there is anything you can say. The world is a better of place without them. Terrible that this happened but would someone please explain how this is being investigated as a hate crime? The people who knew Jennifer would never describe her as having the mentality of a 12 year old. It's my understanding that Jennifer was a graduate of Connellsville Area High School and was not in special classes. It seems to me that it was her attackers who posessed the inferior mentalities.

I began this letter/diary sometime in September 2009. My grandson was born on 8/12/09.
When I told my husband, John that I was pregnant, he was not real happy. That was when I began fighting for my daughter. It didn’t take long for John to change his first response. He has become a wonderful father and continues to this very day to unite with me in the struggle to care for our daughter.
I was very sick most of my pregnancy. I must have had a real bad cold that would not go away. Dr Sandhu gave me antibiotics and cough medicine with codine in it. I don’t know how long I took the prescriptions, but it seems like several months.
The placenta separated and I went into labor 7 weeks early. Jeannie was born with what the doctors called “an unknown virus” Maybe she caught whatever I had. Jeannie was given antibiotics to fight the virus and unknown to the doctors, she was allergic to the antibiotics. Her reaction to them is that she loses blood through her kidneys. Jeannie lost so much blood that she had a seizure on the left side of her brain that left her with brain damage. The doctors didn’t know what to do about her virus, so they finally decided that Jeannie needed my white blood cells. They brought a huge machine into my room and used it to separate my red blood cells from my white blood cells. Jeannie was in Valley Children’s Hospital, then on Shields Avenue, I was in the Sanger hospital, now closed. They drove my white blood cells from Sanger to Fresno to transfuse Jeannie with. That is how she finally got well.
Like I said, this was just the beginning of my fight for my daughter. There have been many struggles over the years. The worst is happening right now.
Jeannie was introduced to Danny Bellman by the ASSIST program. Amy, from ASSIST told me that Danny was a “real sweetheart” and that Jeannie and Danny were chosen to be together because everyone thought they were a “good match”. Jeannie and Danny began going on outings with their ASSIST driver, Marilyn, right away. The first time they went out it was to a movie. Jeannie came home from the movie and told me that she might be pregnant. I asked her how that was possible and she told me that they had sat behind Marilyn in the theater and had sex there. I called a meeting at my house after that with Marilyn, Amy, Jeannie and Danny and Danny’s CVRC worker, Mary. I told them that Jeannie and Danny had sex in the theater and asked them to be sure not to leave Jeannie and Danny unsupervised ever again because Danny wants to have children and he has convinced Jeannie to do this for him. The next time they went out with Marilyn it was to the Fulton mall. Marilyn let Jeannie and Danny go off alone at the mall and Jeannie once again came home telling me that they had sex on the Fulton mall. That Danny had sodomized her and she was in pain.
Jeannie’s last period was on November 5, 2008. Even though I had agreed to let Danny stay at my house because he told me the people he was living with were abusing him and I felt sorry for him, I did not leave them unsupervised. Danny left my home sometime during the 3rd week in October 2008. One reason he had to leave my home is because I thought he was going to give me a nervous breakdown. Danny is very difficult. The other reason I had Danny leave my home is because I found out he is very dangerous. I had a researcher in Merced pull Danny’s criminal file and make copies for me to read. It is all public record information. What I read in the file was very scary. Danny tried to kill a woman he lived with by choking her. The police report states that at one point Danny told the woman he was going to kill her this time. Telling me there had been previous acts of violence. I have been informed by an officer, whose name I do not know, that Danny’s juvenile record for battery and assault cases is extensive.
After Danny left my home Marilyn began taking Jeannie and Danny places again. They went every Thursday. This is how I know that Jeannie got pregnant on Thursday November 20, 2008. They were taken out by Marilyn and left alone again. This time resulting in a pregnancy. There was always confusion regarding the day the baby was due. Jeannie had ultra sound that showed some disturbing measurements. At what was supposed to be 32 weeks gestation, based on the day of Jeannie’s last period, the baby’s head was a normal size for a 34 week fetus and his leg size was normal for a 29 week fetus. I became concerned about the baby having a genetic problem like his father. I repeatedly have asked attorneys and CPS to have the baby tested for a genetic problem, but to my knowledge this has never been done. It would be a good thing to know if we have a special needs child before he goes into a permanent placement.
It was about March 2009 when Danny came over to my house and took Jeannie to live with him at the Californian Hotel downtown. Jeannie lived there under terrible conditions for almost 3 months. Danny was regularly sodomizing her. Jeannie was not under prenatal care and not taking prenatal vitamins and not eating right. Yolanda Estrada had cancelled all of Jeannie’s CVRC services. John and I needed to do something to protect the health and safety of Jeannie and her unborn child. No one would help us. I tried several times to get Yolanda Estrada at CVRC to do something to help. Yolanda just told me that there was nothing she could do because Jeannie was a legal adult and advised me to conserve her. John and I hired an attorney so we could conserve Jeannie. Yolanda attended every conservatorship hearing to state to the judge that Jeannie does not want to be conserved. Finally John and I were awarded temporary conservatorship of our daughter. That very day we went to the Californian Hotel and moved Jeannie out of it. Danny was very difficult and we had to have police stand by while we packed Jeannie’s clothing and other items. Danny told the police at that time that he knows he cannot raise a child and he wanted someone else to do it.
After I got Jeannie prenatal care and vitamins and made sure she was healthy again, I began to realize that I could not raise a child either. I have a business to run and with the economy the way it is right now I am barely making ends meet. I have to work about 12 hours a day. If I miss a day or make any mistakes my competition will take my clients. So, I began looking for an adoption agency for my grandson. This was heartbreaking to me. I found an agency and an adoptive couple that I really liked. They agreed to an open adoption, which was fine with Jeannie and Danny. We would be allowed to spend holidays and birthdays with the baby and the family was agreeable to us visiting him just about anytime we wanted to.
When Daniel was born someone told Danny to sign a “declaration of paternity”. I didn’t know anything about this document. I allowed the adoptive couple to come to my home and pick up the baby. Jeannie was very agreeable and liked the couple very much. We took several pictures. Jeannie signed a form for the adoptive couple to take Daniel to the doctor. He had to get a check up and get circumcised. After a few days the adoption agency sent their social worker over to interview Jeannie. He determined that Jeannie was unable to sign adoption papers due to her disability. They would have to send the adoptive couple to court to get temporary guardianship of Daniel until Jeannie’s parental rights could be legally terminated.
Someone went to the police department and asked the police to arrest me for kidnapping. One of the officers began calling me. His name is Officer Sogohian badge number 795. I may not have spelled his name correctly here. This officer yelled at me many times. He told me that if I did not bring Daniel back immediately I would be found guilty of many serious felony crimes. I continually referred him to my attorney and the attorney at the adoption agency. Both attorneys told me not to worry because I had done nothing wrong or illegal. Nevertheless, having this officer call me repeatedly was unnerving.
Yolanda Estrada began calling me as well. Yolanda told me that I had stolen Jeannie’s baby and I was going to be arrested for kidnapping. Yolanda yelled at me on the phone and told me that Jeannie had never intended to let the baby be adopted. Yolanda has a bad habit of interrupting. When Yolanda called Jeannie to ask her about the adoption Jeannie tried to tell her that she wanted to keep her baby at first, but realized that there was no way she could raise a child and so she had decided to let him be adopted. Yolanda always cut Jeannie off before she could finish talking. All Yolanda heard was that Jeannie wanted to keep her baby. I don’t know why Yolanda had no help to offer me when Jeannie was living at the Californian Hotel, but as soon as Daniel went to the adoptive family, Yolanda begin showing a remarkable interest in Jeannie and Daniel. She has attended every conservatorship hearing and every juvenile court hearing.
Danny went to the guardianship hearing and demanded his baby back. A woman named Debbie, who is with the ASSIST program, drove Danny to Sacramento to attend the 8:00am hearing. The judge granted custody of the baby to Danny and CVRC placed them in a temporary emergency mentor home. After less than 2 weeks something happened and CPS removed the baby from Danny’s care. Daniel was brought to me on a Friday night. It didn’t take me long to remember that I cannot raise a baby by myself. At this time Jeannie had been moved to a CVRC group home.
The reason Jeannie was moved is because she was ordered to have a temporary court appointed conservator and he let her move out of my home at the request of Yolanda. Jeannie has been living in the group home for one month now. Yolanda has not requested Jeannie’s SSI checks or any other payment for rent or care. The group home is a 24 hour care facility and I’m sure it is very expensive, however no one has requested any payment for Jeannie’s care.
The temporary court appointed conservator was assigned to Jeannie because I stated on the original conservatorship petition that John and I were planning to request guardianship of the baby after he was born. I also said on a different document that I began searching for an adoption agency at the same time or before I signed the document stating I wanted guardianship of him. This was my mistake on dates. These two cases have gotten so complicated that I was mistaken about dates on this one thing. The conservator is Gary Healey. Gary has told me many times that he has teenage daughters and he “knows how this works” Gary suggests that we let Jeannie and Danny spend as much time together and on the phone as they want. That way he believes that “Danny will be Danny” and Jeannie will see him for what he is and break up with him. Gary says that his teenage daughters have had boyfriends that were abusive in one way or another and if he just stayed quiet they figured it out for themselves. The problem here is that Jeannie is not a teenager. She is almost 29 years old. In some ways Jeannie is more like a 6 year old child. Danny has convinced Jeannie that she is a legal adult and no one can tell her what to do. This has resulted in Jeannie behaving in unsafe ways. Being disabled gives Jeannie no skills to get herself out of unsafe situations. Jeannie is and always will be unable to fix her mistakes. Many times I feel like people do not have any respect for Jeannie’s limitations. They expect her to perform in the same way as a person with no disabilities.
After spending the weekend with Daniel at CPS’s request I remembered that I cannot raise a baby by myself. I am 57 years old and work long hours. I called CPS and asked them to place Daniel in foster care until the adoptive couple could have him back. Little did I know that they would probably never see Daniel again. Jeannie and Danny were ordered to attend parenting classes, which they have been doing. They are attending the same class at night and are each being picked up and dropped off at the class. I am very afraid that Jeannie will become pregnant again during the time they are unsupervised at the parenting classes. Since Jeannie and Danny have a history of having sex in public places, I am afraid that they will go to the bathroom or parking lot and make another baby. Jeannie has said many times that her and Danny are planning to do whatever it takes to have another baby and this time they are going to keep it a secret. Jeannie and Danny were also ordered to have 2 visits per week each with Daniel, supervised separately. They are not having their visits with Daniel separately. They are having all of their visits together. Again, there is a bathroom in the building. Jeannie told me that at one point someone wanted her and Danny to visit with the baby separately, but she told them that if Danny was not going to be there, she wouldn’t go at all. Danny has informed CPS that if they let me have Daniel over to my house for a visit that he will sneak over here and steal the baby from me and run away with him. I guess the only way he would be able to take Daniel from me is by force. As far as I know, there has been no police report filed against Danny for criminal threats. CPS told me that we cannot charge him with anything; this matter has to be addressed in juvenile court.
At one of the hearings for Jeannie’s conservatorship, Jeannie gave Danny $200.00. Danny had told Jeannie on the phone to bring him the money and he would buy her a cell phone and put the monthly fees on his cell phone account. Jeannie never got the cell phone and when she asked Danny about it he told her that he did not know what happened to the money. He also asked her to bring him another $200.00. When Jeannie asked me to let her have the money to give to Danny, I refused. Because Jeannie is now living in a group home, she is not allowed to have money on her person. When Jeannie first arrived at the group home they took all her money, I think she had about four or five hundred dollars. They put her money in a safe. Jeannie has been calling me since the first of the month and asking me to bring her SSI money to her at different locations. She wants me to sneak the cash to her so they won’t put it in the safe. I have refused to do this, because I think she will give the money to Danny. Jeannie says she and Danny are saving money to run away together. Jeannie told me that she and Danny are going to run away and get married. Jeannie told me that she spoke with her attorney about getting married and he said it was fine with him. Danny has said many times that he will never marry because his SSI would decrease quite a bit. Danny also told John and me that he does not love Jeannie and does not want to live with her. Danny also told the counselor at the Californian Hotel when Jeannie was still pregnant, that if it were not for the baby he would not want anything to do with Jeannie.
Jeannie has told me that the woman, Debbie, who drove Danny to the Sacramento hearing, is going to adopt Daniel. Jeannie told me that Debbie said she will let her and Danny visit Daniel anytime they want to. Debbie has attended all of the juvenile court hearings for Daniel. I don’t know why Debbie would attend those hearings unless she is indeed interested in adopting Daniel.
Jeannie has also applied for credit at a cell phone store. One thing I wonder is who drove her to the store to apply for credit and helped her fill out the application. The store contacted me to verify the address Jeannie put on the application. Which was my home address. Jeannie applied for credit under the name of Jeannie Bellman. Maybe someone needs to tell her that applying for credit under a false name is illegal. Jeannie’s name is Jeannie Harris. Danny’s name is Danny Bellman. For some reason they put the name of Daniel Lee Hardy Jr. on the baby’s birth certificate. No one has the last name of Hardy. This is the name Danny had before he was adopted by the Bellman’s.
What will Jeannie and Danny do when Daniel goes to school and everyone wants to know why his last name is not that of either his mother or his father? How will Jeannie and Danny get Daniel to and from school? Who will help him with his homework? Who will comfort him when the other children make fun of his parents? Will he ever have the opportunity to become evolved in sports or scouts? Who will attend back to school night or PTA meetings? Who will help him become a responsible, honest, compassionate man? Who will guide him in his choice of career, wife, religion? There are many things required in raising a child that Jeannie and Danny are not capable of doing. The adoptive family we chose together could have provided all of those things and more.
Jeannie has been placed in a CVRC day program called Vocation Plus. Danny was in the ASSIST day program. A few weeks ago Yolanda authorized Danny to begin attending the Vocation Plus day program every day with Jeannie. I am hoping that Yolanda is aware of how hard Jeannie is trying to get pregnant again and will keep an eye on the two of them. I also learned today that the first day Danny attended the Vocation Plus day program with Jeannie, he lost his temper and yelled and cussed and hit something until his hand was bleeding. I have been told that Danny was suspended from the program after that. I do not know for how long.
Jeannie has told me that sometimes on weekends her and Danny have plans to get together. Jeannie told me one time that Yolanda was going to drive them for a visit with each other and another time Debbie from the ASSIST program was going to drive them for a visit on weekends. I don’t know if that has ever happened or not. I think one of the weekend visits was cancelled because Danny was kicked out of the mentor home he was living in. I think Danny has been moved four times since Daniel was born. I don’t know how many times Danny has been hospitalized this year for attempted suicide, but I think it’s about 5 or 6 times. He was taken to the PAC unit until they closed. After that he was taken to the PUFF unit. It’s scary to think that he might decide to kill himself and Jeannie and Daniel at the same time. I read about people doing that in the Fresno Bee all the time. The last time we went to juvenile court Danny became angry and had to be removed from the courthouse by three guards. I was informed that Danny was taken to the PUFF unit at that time. There have never been any charges filed against Danny in the adult criminal court for even so much as disturbing the peace.
One of the things that was supposed to be done is that Jeannie and Danny were ordered to have a mental health evaluation. As far as I know they have not done that. I believe CPS also recommended that Jeannie and Danny attend anger management classes. I don’t think that has been done either. John and I have repeatedly requested that Jeannie receive mental health counseling of some kind. As far as I know that has not been done either. In the event that Jeannie and Danny have a mental health evaluation and are found to be mentally competent, I suppose that would mean that they would no longer be illegible for SSI or CVRC services. I don’t think people who are mentally competent can receive benefits that are entitled for mentally disabled people. Jeannie had a mental health evaluation when she turned eighteen. It was required in order for her to continue receiving SSI benefits. At that time the doctor who evaluated her told me that Jeannie’s I.Q. is 50. He also told me that an I.Q. of 90 is average and an I.Q. of 70 is “legally retarded”.
2/15/10: I have not updated this letter for a while. The events are becoming harder to describe. We have been to court more times than I can count. In Jeannie’s court the judge ordered absolutely no contact between Jeannie and Danny. No supervised or unsupervised contact. No phone calls. No letters. It didn’t take long for that order to be violated. The bailiff from the courtroom saw Jeannie and Danny walking on the mall holding hands. He said there were two adults with them. Since their drivers are Marilyn and Debbie, I can probably safely say they were the two adults. When the court investigator found out about it, she quickly interviewed everyone and filed a report with the court. The next time we went to court this violation was not even addressed. My attorney told me that the judge said we cannot keep them apart. I think we could have kept them apart if everyone had followed the judge’s orders. My brother saw Jeannie and Danny coming out of the Californian Hotel and was supposed to testify. This never happened either. What did happen was that the judge ordered 5 hours of supervised visits for Jeannie and Danny per week. The only people that can supervise the visits are Gary, John and I. The judge also ordered 90 minutes of phone calls per week. The phone call order has never been followed. Jeannie told me that she is talking to Danny on the phone with no limits. Someone has taken Jeannie to another cell phone store and she has purchased another cell phone. Jeannie and Danny are on the phone all throughout the day every day. Jeannie could not get to the cell phone store all by herself. I can’t help but believe that, once again, her driver has taken her to the cell phone store.
Jeannie spent the weekend with me this past weekend. She was here with me from Friday afternoon until Sunday night. That’s how I found out about her cell phone. I saw her using it. Jeannie told me many things while she was here. The worst thing she told me is that she wants to discontinue her visits with Daniel. Jeannie said that Debbie told her if she quits visiting the baby Debbie will never take her anywhere or do anything for her or be her friend again. I can’t imagine threatening a disabled person that way. That seems like a very cruel thing for a person to do. I don’t understand how Debbie could be doing such things. What really has me wondering is what’s in it for Debbie?? Jeannie also told me that Danny’s attorney said they will never get the baby back. If that is true, why isn’t the court over? I have attended all the hearings for Daniel’s case. At the last one the judge told me that I could not talk or write about anything that happened in that hearing. As soon as I am allowed to talk about it, I will write some things that will really scare anyone who reads this.
The judge said that this trial is closed now. If anything new happens, we will have to open a new case. It looks like we have lost the right to conserve our daughter and she has a court appointed conservator forever now. John and I have supervised two visits with Jeannie and Danny, Gary has supervised no visits, since that court date. If we are not being appointed conservators of our daughter, why are we doing the conservator’s job?
3/21/10 Gary said he can never supervise a visit for Jeannie and Danny because he doesn’t have time during the week and he doesn’t work on weekends. John and I have supervised every single visit. We are buying groceries and cooking for them or taking them out to eat. We are taking them to the movies and the mall. We are driving Danny to the bus stop. These are not things we expected to be doing every weekend. Debbie is no longer willing to drive Jeannie anywhere. I am picking her up at the group home on Friday to spend the night at my house, then after her visit with Danny, I am driving her to my mother’s house to spend the night. On Sunday I am driving over to my mother’s house to pick Jeannie up and drive her back to the group home. While Jeannie is with me and my mother on the weekends we have noticed that she and Danny spend no less than six hours a day on the phone. Neither one of them ever mention the baby, not to me or each other or anyone else. Danny has been spending time with his mother who is locked up in drug rehab. Danny told me that his mother is trying to get visits with Daniel. I don’t know if this will ever happen or not, but it seems like a dangerous idea to me. Jeannie is convinced that at the next hearing she will have no conservator because Debbie told her if she gets an IUD that the judge will grant her no conservator. Jeannie said that as soon as the next hearing is over she is going to move in with Danny, who has moved back to the Californian Hotel, and they are going to have another baby. They know that an IUD can be removed at any time because the doctor told Jeannie about that.
Daniel is seven months old now. He cannot sit up by himself. It looks like a problem with his spine. I know his head is very large, but he is able to hold his head up, it looks like his back has no strength. The social worker told me that there is nothing wrong with Daniel. If that is true, why can he not sit up yet?
I am very concerned for the health and safety of my daughter and my grandson. Poor little Daniel was removed from the home of wonderful adoptive parents and lived with his father for a while and now he is in foster care. I am afraid Daniel is not bonding with anyone.
4/7/10 Jeannie has been in the CVRC group home for about 5 months now. She has not been for a dental checkup. Jeannie will not be able to see our family dentist that she has gone to all of her life unless I pay cash for it because Yolanda did not continue paying Jeannie’s Blue Shield insurance premiums. As soon as Yolanda got Jeannie to sign her SSI checks over to CVRC Yolanda has not been to see Jeannie or attended any more hearings for Jeannie’s baby. Debbie has not been talking to Jeannie or taking her places either. No one has purchased anything for her. She has had no new clothes, not even a pair of socks. I have been buying her shampoo, body wash, and even her sanitary pads. I have bought her soda and cookies because no one will buy anything for the group home clients unless it’s diet. Clearly, Jeannie does not need to be on a diet. Jeannie called me today crying because one of her house mates tore up the coloring books I bought her while she was spending the weekend with me. (Jeannie spends every weekend with me) The staff at the group home told Jeannie to go buy new ones and they would pay her back for them. I don’t think Jeannie should have to replace her destroyed items herself. I think someone should go and buy new ones for her. I guess that someone will be me. Jeannie tells me that the weekday staff person at the group home is real nice to her, but the weekend staff person yells at her continually and calls her names.
4/8/10 I replaced Jeannie’s coloring books yesterday. I also bought her a few more things at Toys R Us. I showed Jeannie on the receipt where the prices for the coloring books are. Someone paid her the money for the coloring books. I told her this morning, when she called me, that she could give me the money on Friday when I pick her up to spend the weekend. Jeannie got very upset and said she will not give me the money. Poor thing, she thinks because the coloring books belonged to her that she should keep the money. Well, that’s ok. I’m not worried about twelve dollars or so, she can keep it.
The visit is here at my house again this weekend. These visits are stupid. Jeannie and Danny could have visits until the end of time and nothing would change. People don’t realize that disabled people are used to things like this. They have certain days and times for almost everything. This is a way of life for them. Nothing will change this habit of visits unless we change it. The only way for Jeannie to forget about Danny is if she does not see him or talk to him on the phone. If that were to happen we could get back to our regular lives very quickly. I guess the attorneys think they’re helping, but they don’t have disabled children, so they don’t know how it is.
4/12/10 Jeannie says Gary has told her that her and Danny are doing so well that he is sure when we go to court in May the judge will grant her no conservator. It amazes me that Gary is able to have an opinion of how Jeannie and Danny are doing when he is never around them. If this does happen Jeannie’s plan is to move back into the Californian, where Danny is living now, then she will have the IUD removed so they can have more babies. I hate to think about starting the events of the last 2 years all over again. Jeannie and Danny have not changed one bit. They fight all the time about every little thing. All week long first Danny is not going to the next visit, and then Jeannie is not going to the next visit, back and forth. They yell at each other on the phone every single day. I can just see John and me in 4 or 5 months going to court for conservatorship to move our pregnant daughter out of the Californian.
No one is telling me anything about Jeannie and Daniel. I am just Jeannie’s mother and Daniel’s grandmother, I guess no one thinks that is important. Not once has Yolanda, Gary, Megan, or anyone else called me to tell me what is going on with them or how they are doing. No one has asked me any questions about their health or any family health questions. I have had to rely on only what I hear from Jeannie and Magdalena. (Magdalena is Daniel’s foster mother.) I really think it’s strange that all this time has gone by without a single phone call from anyone involved with my family.
4/29/10 I talked to Magdalena yesterday. She said she had a meeting with Megan and the adoption is going to happen now. Magdalena also told me that Megan said I cannot come over to her house to see Daniel. I called Megan to find out what happened because the judge said it was alright with her if I go to Magdalena’s house. Megan told me that Magdalena doesn’t want me to come over to her house because I am too overbearing. Megan said that Magdalena told her since I have been wondering if there is anything wrong with Daniel she thinks that I am implying she is not treating Daniel well. I cried all night long. I am still crying now. I feel like no one wants me to be Daniel’s grandmother. My own mother was such an outstanding grandma to Jeannie and still is. I just want to be as good of a grandma as she is. I have tried as hard as I can to be nice to Magdalena and Megan. Sometimes the stress is all consuming. I am so afraid I will do something to make one of them mad. It looks like the extreme effort I have taken to be nice to them wasn’t enough. Magdalena has told me many times that it is ok with her if I go to her house to see Daniel once in a while. I don’t know why she told Megan the opposite. The reason I want to go to Magdalena’s house is Daniel has become so attached to Magdalena, in a most normal way that he cries when she leaves him. It breaks my heart to see him cry. I just thought it would be easier on Daniel if I saw him with Magdalena sometimes so he wouldn’t cry.
5/6/10 When Jeannie was here for the weekend last weekend I found out that Danny had caused Jeannie’s ILS worker, Debbie, to be fired. Danny called Debbie’s boss, Amy, and told her that Jeannie had told him that Debbie said something that Danny didn’t like. Amy fired Debbie because of it. Jeannie’s new ILS worker is Angelica.
Jeannie was talking to Danny on her cell phone last Friday night and they got in a fight. Jeannie got mad at Danny and threw her cell phone and broke it. Jeannie told me that she was going to have Angelica take her to the cell phone store on Monday so she could buy a new one. I have noticed that Jeannie and Danny are not following the court order of 90 minutes per week semi-supervised phone calls. Since Jeannie was taken to buy a cell phone, they are spending about 6 hours per day on the phone. (I timed it one day and it was 6 hours.) Sunday afternoon I called Gary Healy, Yolanda Estrada, and Amy and left messages for them to please don’t let Angelica take Jeannie to buy another cell phone, because she is violating court ordered phone time with Danny. Of course, no one listens to me. Angelica took Jeannie to the store and helped her buy another cell phone. I don’t understand why no one has followed court orders from the judge throughout this entire conservatorship case except John and I. They just get away with it and no one gets in trouble for violating court orders. I thought violating a court order was a crime. I guess it depends on who you are. I have not violated any court orders, no matter how hard they were.
Why is everyone fighting against John and me, when we are just trying to keep our daughter safe? If Jeannie moves in with Danny again, they will have another baby right away. Besides, I don’t think an unfurnished hotel room downtown is a good place for my daughter to live. That bull dog gang member beating Danny up proved the area is not safe. What if my brother had not happened upon the scene and called the police and stood with his arm around Jeannie. Would that bull dog person have knocked Danny out and ran off with Jeannie? Probably.
I hope that someone who reads this letter is able to help me keep Jeannie and Daniel safe, healthy, happy and loved.
