Joey's brother hadn't heard from him, so he asked police to do a welfare check on the family's home. No one was there. The dogs had been left unattended. And though police aren't saying what they found, it was suspicious enough for them to call in homicide detectives.

Relatives say the family had no trips planned, nor was it usual for them to leave without telling anyone. But the fact that their dogs were left without care signifies that tragedy is a likely scenario.
Police won't say why the matter is already being considered a homicide investigation, but we'll keep you posted.




Scariest part about this is there Isuzu was found abandoned by the Mexican Border. This does not say alot of good things. If there is an assailant, attacker, or the like it tells me they are no longer on U.S. soil! (not good) Wonder if it is a Mexican citizen on there way back in or an american citizen on there way back out.

Reality tells all, Maybe it was a way to start a new life with nobody knowing what happened. Or they owed money to people he bought fountains from and he didn't pay. So they got more then needed.

Here is what I found: Joseph McStay filed a Chap 7 Bankruptcy in 2004 while living in San Clemente. Almost all debts were large credit cards from AM EX to Discover. Then in 2009, he and his wife, who has several aliases, were EVICTED from the San Clemente rental property they were living in. Plese tell me how he was able to get a mortgage in 2009. Impossible. But it gets better. In 2002, his brother and his wife had filed their own Chap 7 Bankruptcy for large credit cards bills. And even better, Joseph, Michael and the father were all in business together at one point. I would be willing to bet that this DISAPPEARANCE has been planned for a long time and Joseph's family know all about it. That's why there is no panic, no rewards. They skipped out; staged the disappearance etc. They are on the run. Shame on these family members from using Texas Equasearch and even asking for donations.

Upon the sheriff's department entering the McStay residence, the only clothing found in any their closets were two men's shirts, two pairs of women's heels, and FOUR FUR COATS. All of the rest of this family of four's clothing were found strewn on their floors. No hangers; drawers; suitcases etc. Tim Miller from Texas Equusearch commented how strange it was also that they could not find any shoes. True that they were decorating, but they had lived in this house for four months. Also, what does it say about a woman who drives a 16 year old SUV, whose husband was bankrupt 5 years ago, and was evicted from her rented house 4 months ago that she could afford four fur coats?
Here is another fact. Joseph McStay was adopted. Empirical research [see JAMA 2005] continues to find that adopted males are overrepresented in the mental disordered population including sociopath and psychopath disorders. We are not implying Mr. M murdered his wife and kids, but here is another interesting fact regarding adoptees which comes from the FBI. The FBI estimates that of the 500 serial killers currently in the U.S; about 30 or 16% have been identified as adoptees.
Posted 03/28/2010 at 01:26:10 PMThis post is addressed to the McStays who undoubtedly have been following the news of their vanishing act with intensity. It is also for all of you who, up until the McStay computer searches for passports was confirmed, thought that these people were not the "type" to stage their own abduction.
It now clear that Mr. and Mrs. McStay had been planning this escapade since atleast January when they began searching for info about passports into Mexico for their two kids. It's also pretty clear that Mexico was their pitstop and that they had another destination in mind. I am guessing that they flew out of Mexico into a yet another location where you need a passport to enter carrying a few possessions and a lot of cash they stole or obtained illegally.
Mr. and Mrs. McStay, do you still believe that running out on the people who love you by orchestrating a midnight run is less cruel than the truth? Are you still so sure that you can hide from your past? While its not a crime to burn every bridge a person has with his or her life-family, friends, home, career-no sane person does that for adventure. Based upon what we know about the McStays already, money was their downfall. What ever they did and wherever they are now, I hope it was worth it.

The PACER database is for official use only and access to the system is for federal employees of the United States Court, US Attorneys Office, and Federal Agents with a proprietary need to know. Public disclosure of information obtained from your PACER access can result in criminal prosecution and administrative sanction up to and including termination from your position that requires your access to the PACER system.
I would seriously consider deleting your braggadocios post concerning the information you obtained about the McStay bankruptcy, etc...

We hope and pray that you are an imposter and that you are not law enforcement since this would mean that you are another amazingly incompetent federal civil servant. FYI, your unique access to Pacer is shared with EVERY OTHER LIVING MAN, WOMAN AND CHILD WITH A CREDIT CARD. We strongly suggest that you review the Pacer website which states, in part:
"What are the acceptable uses of the data obtained from the PACER system?
The PACER system provides electronic access to case information from federal courts across the United States. The information gathered from the PACER system is a matter of public record and may be reproduced without permission. However, the PACER customer assumes all responsibility for consequences that arise from use of the data."
Posted 04/04/2010 at 01:14:28 PMSince law enforcement feeds information to the public several days after they have received it, they likely already know if the tip about Baja was legit. Regardless, the fact that the FBI has come into the investigation is unsettling. They do not assert jurisdiction lightly and therefor, there must be high probability that one or more of these family member's circumstances warrant an investigation by federal authorities. We believe the FBI has asserted jurisdiction on the grounds that the children are in mortal danger.
Unless the McStay's are nuts enough to orchestrate their "runaway bride" act in the hopes of getting a reality show, it is clear that they fled their home out of shear terror for the safety of their kids. This is supported by their obvious need to choose between their children's well being over that of their pets. Simply put, they had no choice but to abandon these pets.
Many of us who have been following this saga believe that their disappearance is related to the purchase of their new home. Since it would have been highly improbable that Joseph would qualify for a conventional mortgage due to his bankruptcy and credit rating, it is likely that he had to have paid all or a large portion of the purchase price in cash. The source of that money is likely the key to this entire puzzle. Whomever is after this family is also likely connected to the ability of Mr. and Mrs. McStay to buy this house. Mr. and Mrs. McStay likely made a deal which was the biggest mistake of their lives.
