• Samildanach: I'm a prosecutor and you are correct. The deceased's accomplices can be charged for his death. Any death that occurs during the commission of a felony is considered felony murder. It doesn't matter that the accomplices had no direct involvement in their friend's death.

• Ryan, for the record being bi-polar does not make you inconsistent in your positions. It is a mental condition that causes the afflicted person to have elevated periods of mania, and exaggerated or low periods of depression. There is more to it than that but you are confusing multiple personality disorder with something I have and I have to tell you the two conditions have almost nothing in common. I am not offended or anything, just trying to point out the error in your statement. What the person you are referring to has is a case of the "inconsistencies", horrible thing that.

• Reid, even people that have training can panic during situations like that. All the training in the world doesn't make much difference if the person in question doesn't already have what it takes to hurt another human being in the first place.

• I was wondering the same thing as Frakz. Even though it was their accomplice who was shot and killed ... can't the other two be charged with homicide - because the death occured during the commission of a felony?

• I hope that the good guy and bad guy are both the same race because the next thing that happens is the family of the deceased cry "hate crime" and "racially motivated" killing and try to sue over the death of their loved one for a gazillion dollars. I really hope that good guy is absolved of any manslaughter or murder charges stemming from this. He was only protecting his fiancee and himself. If those other guys hadn't fled and come into the main part of the store, they probably would have been shot too out of pure panic. I can't imagine many people (without serious training) can stay calm and collected when faced with a life-or-death situation.

• Bacon, PLEASE READ THIS, I don't skim through and misquote, when I quote someone I copy what they posted and paste it just so I don't misquote. Take your own advice sir, I never said that you would "expect him not to shoot when the other robbers are obviously armed and could have shot him" if I did please enlighten me. In regards to the other story the guy didn't realize any trouble, he saw a car that didn't look right. That's all. And the one with the stabbing, if you wouldn't investigate your own home for trouble then that's pretty pathetic. I don't know about you but if I walk into my home and think there might be a robber or someone inside, I'm not going to tuck my tail and run away. I'm going to defend myself and my home. And don't get me wrong, I agree with you on this story, the guy 100% did the right thing.

• If the bad guy is still trying to fight to get the gun back, then unarmed or not, shooting him is still justified self defense. And in some states, the 2 accomplices can be charged with murder, even if none of the 3 of them did the shooting. Somebody, even if it's one of them, died during the commission of a crime they were directly involved in.

• Not that we're "ganging up" on you without letting you respond, Bacon, just wanted add that I completely agree - your two different attitudes are a little off. I agree with this guy's actions, but was expecting you (based on your previous comment) not to. The other guy was wondering about a car (of course it's going to be reported that he "suspected something was wrong" when what likely happened was he told the police "I noticed the vehicle and didn't recognize it" not necessarily "I was suspicious). This guy did disarm a guy and then use that guy's gun to shoot him. I'm sure once the gun was out of the guy's hands, he really had no other weapon to attack with. Again - I completely agree with your post as well as with the guy that shot the robber. I am just in total shock to see you disagree with yourself from two different stories!

• Bacon, Eddy is 100% correct here, do you even think before making these postings?! While I agree with the fact that this costomer shot the bad guy, and deserves a medal, he DID shoot an unarmed assailant. Twice. I think he definately did the right thing but you have a twisted sense of what's wrong and right as far as self defense. In another posting you disagreed with the fact that a man with a concealed weapons permit shot and killed an armed robber that was trying to rob and kill him. How can you justify the example of self defense given in this story, and not the other?! I think you even mentioned the guy who stabbed to death an armed robber when he came home to the robbery in progress. Are you bi-polar? maybe you've got some sort of multiple personality disorder. Check it out, if a bad guy with a gun, commiting a crime, gets killed by the people he is attacking, IT'S JUSTIFIED! Mercy to the guilty is cruelty to the innocent.

• It's hard to tell from the report, but it sounds like the customer shot the bad guy during the struggle, Eddy, or a split second after he got the gun. There's nothing to indicate he grabbed the gun, took aim, and just executed the guy. Pretty sure this is straight up self-defense, though we'll keep you posted if we find otherwise.

• Umm....I'm confused Bacon(unless it was sarcasm). In your other posts you rant about proper action regarding self defense. The way I read the story, the customer DISARMED the badguy and THEN shot him when he was(I'll admit assumed) disarmed. If the robber was shot in the struggle or was still attacking him/them then fair enough. If NOT, then reckless endangerment-->murder/manslaughter.

• You're right, Bacon, in that the guy had to go because his fiance was threatened. It was his only move, and the right one. But I think he's still lucky he didn't get shot. Then again, since we don't know anything about the customer or the bad guy, maybe the bad guy was an obvious pussy -- aren't they all? -- and he knew the odds were good. It just would have been tragic if the customer was shot instead. But you gotta give him points for manning up.

• NOW THIS IS A PERFECT EXAMPLE OF SELF DEFENSE! Now all you QTV people (quick to vengeance) can see how your supposed to handle the situation in the first place. This guy needs to be given a Medal of Honor by the Pres. A+ Story in my book Pete! GREAT WORK! Perfect example of what constitutes self defense when faced with the threat of harm to you and your family, and the way to do it!
