He threw the toddler onto a mattress, but Jovani got back up. So Garcia began to pummel him, punching him in the kidneys, stomach and chest.
Mother Lawanda Martinez would later take the boy to visit his grandma, Wanda Williams, in Racine, Wisconsin that day. Grandma noticed that Jovani was barely conscious, kept falling, couldn't stand up on his own and was shaking. She urged Martinez to take Jovani to the the hospital.
But mom said he always acted this way and took him home. She gave him Tylenol that evening. But by 11:30, she noticed that his body had gone cold and his lips blue.
By the time they arrived at the hospital, Jovani's kidney's were failing. He wouldn't survive. A pathologist discovered that his intestines were perforated, his liver and pancreas were lacerated, and he had broken ribs. This wasn't something that could be caused by accident.
Garcia, 40, has now been charged with reckless homicide. Martinez, 23, is charged with neglect of a child causing death.

I know this story doesn't go into detail - but did the mother know what the boyfriend had done??
All of these stories about mothers with men who beat their children just makes me feel sick inside. My mom dated some real losers as a single mother, but none that ever touched us. They touched her, and she got rid of them, but never us.
This is a terribly sad story. I'm glad they are getting charged, and hope it's an easy conviction.

Kids spill milk..he was probably being a normal kid and having fun. As for the stupid ass mother, "He always acts like this..." What kind of effen excuse is that?! Your poor boy has been badly beaten! WTF?! I bet he cried from being in pain before they went to his grandparents house, but she probably was too busy being a stupid ass to pay attention to her own son. This really saddens me that this world is comming to this. Every day that passes, this world we live in gets colder and colder. This story just proves it. Give the parents the death penality! They absolutely deseve it!

The marine was charged with MURDER....SO SHOULD THIS SICK PRICK!!! Another immigrant that we should have run a background check on before allowing into the country. As most of you know, I'm not much for Capital Punishment, but a Public Stoneing(sp?) seems justified here.

God, I hate these bastards that are so weak minded that they feel justified in beating a baby. A close second is the women who allow them to do this and don't protect their children.

All of these creeps, if not US citizens, why should we give them the same liberties and freedoms and due process that we give our own citizenry? You know us dumb bitches paying all the taxes for low lifes to breed anchor babies and get free hospital stays. Sorry for the rant...working on my taxes today!

UTAH is the ONLY state in the US that still allows Firing Squads, and then it is ONLY to inmates that chose the option before it was removed as an option. SO...Sarah, I don't think we'll see this guy going in front of a firing squad in America anytime...but sending his ass back to Mexico might result in a different outcome, especially since his girlfriend's "anchor-baby" is now deceased, so they can share a prison bus ride back to Mexico. Which oddly enough, we have US Federal Prisons in. Yes there is a max security US prison located just out Mexico City. Which has puzzled me in it's legality since I first learned of it's existence. Off topic I know, but it begs the question of whether you can be held as a prisoner of the US justice system and incarcerated in Mexico, a foreign country....Also if you escaped, would they be able to recapture you if your offense didn't warrant extradition???

Off Topic: I was watching Haunted History or one of the Ghost shows on TV the other day. It was an exploration of an old prison. They mentioned that there was a hillside outside of the compound and when they had an execution to carry out (by hanging or firing squad), the townspeople would gather the kids and a picnic lunch and hit the hillside to watch.
Which brings me to my suggestion... some people claim the death penalty is not a detterent to crime. Maybe because it's too surreal and so many appeals before one is ever carried out, it just doesn't have the same impact on would-be criminals. I think we should televise each and every execution. Instead, we show all the bleeding hearts picketing the outside of the prison at the time of execution. I think it's time that people understood the real outcome of a death penalty for heinous crimes. Then maybe it would become a detterent.

They get found guilty, they should get an appeal, then they (any convicted perp)should be punished accordingly,and swiftly, any means possible! Eye for an eye!!!!Am sick of seeing the victims made out to be at fault, and the perp. is made out to be a victim! Wait and see, we will hear that this ass had a bad childhood, and that mom was molested or something as a child! So what?!! I know lots of people who come from a bad place and they are productive members of society. Sorry for going on,not meant to offend, I just get so tired of the bs!!

Maybe you're just assuming he's from Mexico (and, of course, not Honduras, El Salvador, Paraguay, etc...) because of his name? I guess that's fair. So I'll just assume that you come from a pig's ass. After he threw the kid on the mattress, by getting up, Mr. Garcia saw the kid's actions as essentially "challenging his manhood" & questioning his authority. He wanted to "teach him a "lesson". Were his actions justified? Of course NOT!

He should be castrated with a rusty spoon & the bloody stump dipped in boiling hydrochloric acid. Then he should be made blind & deaf be means of pouring molten lead in his eyes & ears. After that, force him to ingest several pounds of salt & leave blind & deaf, him in the middle of a desert with no water. Forgive me if by not suggesting outright execution I seem a bit "soft". Perhaps showing pity is a weakness, but I am not completely without human compassion. Anyway, we all know that won't happen. But believe you me, he will "get his" in prison, provided he doesn't get the death penalty.
Also, let me clear something up. When I wrote I was "amazed nobody is defending his actions...", I only meant that there are always a few assholes with degenerate opinions. Remember the case involving a man, a mother & baby, & a Target store? The man, a complete stranger approached the mother & demanded she "shut that baby up" or he would "do it for her". She tried to get away, after which he followed her & struck the baby several times in the face, & also struck her in the face. While reading comments from multiple websites, I was appalled & utterly disgusted to see how many people not only thought the mans actions were appropriate, but some actually applauded them. I am not talking about a few. Some websites has 25% & even 50% agreeing with the mans actions! I thought there would be a few degenerates defending Mr. Garcia. Thankfully nobody here has.

This mother is responsible as are all the parents that bring and abuser into their child's life and then do nothing when the abuse starts. They both should spend the rest of their lives in prison.

It has absolutely no correlation between their crime only being committed by illegal latino immigrants. That is an ignorant assumption and I'm sad you thought I would think that way. I was simply pointing out the fact that they may possibly not be from this country. I didn't say they were, I was basically speaking out of frustration because of the petty charges brought against old Garcia. My statement was to imply that if the US justice system wouldn't be able to hand him the necessary punishment, perhaps we could determine if he was born in America or whether he naturalized here later. Even if he did it 100% legally I still think we should reserve the right to ship him back. Why should we be responsible for housing the world's sick, hungry, tired, AND CRIMINALS?

WTF, Let us also not forget the details in the story when the child was obviously ill, and yet the mother refused to go to the hospital. Is this the actions of someone who's a legal citizen of the country, or one with a questionable legal status? Personally, I believe in eye-for-an-eye although it may be harsh and down-right cruel, but for WHAT of these poor children. Yeah, I think it's probably going to remain an unkown at this time. If you were the government, would you look into his status and how many times he's probably been picked up for other stuff and let go? If he's in Wisconsin, it's highly unlikely he's Mexican anyhow. Probably from El Salvador.

There are many shades of gray between natural born citizen and illegal alien. There is permanent resident, visitor, student & work visas. There is "naturalized" citizen. I'm only talking about people who are NOT SUPPOSED to be here and know damn well they are not and then on top of that, commit murder? Do you think other countries should have to pay to house America's criminals by the droves? Since you ask for a solution, I offer: Go ahead and have the trial, if convicted and an illegal, put his DNA on file and let him know that if he is ever found in the US again, he will be executed. I'm sure you will say that is harsh, but look at it this way, if the police in El Salvador or Columbia had arrested him, I doubt he would have survived the arrest.
I hate when women put their men before their children...such selfish women who don' even deserve to have children. It grosses me out and I just want to slap them!
