29-year-old Jason Fordell had spent the night selling the leather goth clothing he designs at a Manhattan club. It was now 5 a.m. Sunday morning, and he was taking the train to his home in the Bronx. Three black guys on the train were making a lot of noise, he says...
So he asked them to keep it down. "I asked them to lower their voices and then they started in on me,
'Shut the fuck up, white boy,'" he told
PIX-TV. "We'll beat the shit out of you, cracker.'"
Fordell, dressed in black goth wear to sell his goods, says a Hispanic man soon joined in the taunting. "They're calling me cracker, and so I called him spic." (See

Fordell called the cops, asking them to meet him at a coming stop. But the call got dropped. Before the train reached the stop, Fordell says he was attacked.
He claims the three black guys and the Hispanic guy jumped him, beating him up and stealing his leftover goth wear. The attackers fled when the train stopped. Fordell gave chase and the fight continued.
When police arrived, the original attackers were already gone. But Fordell was able to identify 54-year-old Barminth Ramoutar of Queens, who had joined in the beating.
So far, police aren't calling this a hate crime. Maybe it's because Fordell called a man a spic. Something tells us he also may be a dick.
But it would seem that any group of men who use racial slurs, then beat and robbed a man, would automatically qualify for hate crime charges. If the situation had been turned around, and three white goobers did the attacking, you can bet police would be jumping all over this. After all, New York has the country's toughest hate crime laws.
