Jesus Canul Charged With Murder For Shooting Mugger David Abbot in the Back

26-year-old restaurant worker Jesus Canul had gone to a Walmart in Logan, West Virginia to cash his paycheck. As he was leaving the store, 37-year-old David Abbot grabbed him from behind and held a scissors to his neck, threatening to slice his throat...
As he held the scissors to his Jesus' neck, Abbot began fishing in Jesus' pocket for his wallet.
Rodney Sells, Jesus' landlord, had given his friend a ride to the store and witnessed the whole thing. As Abbot dug in Jesus' pockets, Jesus did some digging of his own, pulling out a gun. He pointed it at Abbot, who was holding him from behind. That's when Abbot finally found the wallet and began to take off.
Abbot was running only a few feet away when Jesus shot him in the back. Abbot ran into Walmart, where he eventually collapsed. He would not survive.
But in a weird twist, the cops decided to charge Jesus with first-degree murder. Reports differ on whether he had a permit to carry the gun. But friends say he'd been beaten before to the point that he was hospitalized, so he'd taken to carrying a gun for protection.
In the latest incident, they say he likely was fed up with being picked on and decided to fire away.
But police are calling it a premeditated killing. They say Abbot was clearly trying to flee, and that Jesus was no longer in danger when he fired.
